This Agreement Controls. Notwithstanding anything to the contrary set forth in the Customer Agreement, in the event of any inconsistency between this Agreement and the Customer Agreement, the terms of this Agreement shall prevail.
This Agreement Controls. If the terms of this Agreement contradict the terms of any purchase order or order acceptance, the terms of this Agreement will take precedence. No boilerplate terms in either party’s order-tracking documents will apply.
This Agreement Controls. Notwithstanding the content of any purchase order, sale order, sale confirmation, or any other document relating to the subject matter of this Agreement, this Agreement shall take precedence over any such document, and any conflicting, inconsistent, or additional terms contained therein shall be null and void.
This Agreement Controls. In the event any provision of this Agreement and any of the other Transaction Documents shall conflict, the provisions of this Agreement shall govern.
This Agreement Controls. In case of conflict between the provisions of this Agreement and the provisions of the General Contract and/or Performance and Payment Bonds, this Agreement shall control. Further, this Agreement, the General Contract and the Performance and Payment Bonds constitute the entire Agreement between Owner and Surety and, together, supersede all prior negotiations, representations, offers, other writings and oral statements of every description.
This Agreement Controls. If there is any conflict or dispute between this Agreement and any other agreement between Executive and the Company, the terms of this Agreement shall control.
This Agreement Controls. Other than with respect to an Event of Default or other breach under a Note, in the event of any conflict between the terms of a Note and this Agreement, this Agreement shall control.
This Agreement Controls. This Agreement shall control CL's reproduction and distribution of the Courseware and Documentation. All different or additional terms or conditions in any CL purchase order or similar document shall be null and void.
This Agreement Controls. Other than with respect to Section 11(d), and notwithstanding anything to the contrary set forth in the Customer Agreement or the Primary Custody Agreement, in the event of any express inconsistency between this Agreement and the Customer Agreement or the Primary Custody Agreement, the terms of this Agreement shall prevail.
This Agreement Controls. In the event of any conflict ------------ between the provisions of this Agreement and those of any other agreement between Dentist and Secured Party, the provisions of this Agreement shall control.
