Third Party Tools. User agrees that User’s access to and use of Third Party Tools may be subject to additional terms and conditions, and Partner will agree to and comply with such terms and conditions to the extent applicable to User’s activities permitted by this Agreement. Except where otherwise expressly stated, Oracle does not guarantee compatibility with any third party products or services, including the Third Party Tools and Oracle will not be responsible for any changes or new development therein which might interrupt use or interaction with the Service or the SuiteCloud Technologies. For the avoidance of doubt, Third Party Tools are not SuiteCloud Technologies.
Third Party Tools. Any Third Party Tools used by a Newco other than ----------------- the Company as of the Transformation Date, including without limitation those Third Party Tools set forth on Schedule 3.4.

Third Party Tools. You agree that we may utilize certain third party software tools (“Third Party Tools”) to exchange information or process data in connection with the Services. You acknowledge and agree that we do not own or control the Third Party Tools and consequently we will have no liability or responsibility to you or any third party for any loss, disclosure or corruption of any of your Confidential Information uploaded, stored or processed by the Third Party Tools.
Third Party Tools. (a) Gotcha! may provide the Customer with access to third-party tools, which Gotcha! neither monitors nor has any control over input. The Customer acknowledges that and agrees that Gotcha! provides access to such tools “as is” and “as available” without any warranties, representations or conditions of any kind whatsoever and without any endorsement. Gotcha! shall have no liability whatsoever arising from or relating to the Customer’s use of optional third-party tools.
Third Party Tools. 23.1. There may be third party-owned software, applications, products, platforms and other third party-owned copyrighted material as set out in the Commercial Details, Fee Schedule and/or a Statement of Work that you may use in connection with, or that we supply to you as part of, the Smart- UI Products (Third Party Tools).
Third Party Tools. If Publisher uses any third-party tools to develop PlayStation Compatible Products or any portion thereof, Publisher shall be responsible at Publisher’s sole risk and expense for ensuring that it has obtained all necessary licenses for its use.
Third Party Tools. Client understands and agrees that certain third party tools (the “Third Party Tools”), such as open source software, application programming interfaces, and font software packages, may be incorporated within or form part of the Deliverables, and that such third party tools are subject to the terms of the applicable license (including the warranties and/or disclaimers therein), and are not owned by Client or Rootstrap; provided, that, Rootstrap will obtain Client’s prior written permission prior to incorporating any Third Party Tools that either (a) are subject to an open source license that either (i) is “commercially restrictive” or contains a “share alike” (or “copyleft”) requirement (as such terms are commonly understood in the software development industry), or (b) require Client to pay any fee to a third party.
Third Party Tools. You acknowledge that effective utilization of the SDK may require the use of a development tool, compiler and other software and technology of third parties. You are solely responsible for procuring such third party software and technology and the necessary licenses for the use thereof.
Third Party Tools. Company acknowledges and agrees that Users may choose to utilize certain third-party videoconferencing, communications tools, and other services outside of the BetterUp Platform in connection with BetterUp Services, e.g., Skype or FaceTime (“Third-Party Tools”). While User Data provided to BetterUp through Third- Party Tools remains subject to the BetterUp Privacy Policy, use of Third-Party Tools themselves is subject to the terms and conditions of the Third-Party Tool providers. BetterUp Analytics may be diminished or unavailable if third-party tools are used in connection with BetterUp Services where those third party tools have not been integrated into the specific product offering. BetterUp is not responsible for the operation of or any changes to the Third-Party Tools or the acts or omissions of Third-Party Tool providers.
