The Documentation Agent. The Documentation Agent, in its capacity as such, shall have no duties or responsibilities, and shall incur no liability, under this Agreement and the other Loan Documents.
The Documentation Agent. The Lender identified as the "Documentation Agent" herein shall not have any right, power, obligation, liability, responsibility or duty under this Agreement (or any other Loan Document) other than those applicable to it in its capacity as Lender. Without limiting the foregoing, the Lender so identified as the "Documentation Agent" shall not have or be deemed to have any fiduciary relationship with any other Lender by virtue of acting as Documentation Agent. Each Lender acknowledges that it has not relied, and will not rely, on the Lender so identified as the "Documentation Agent" in deciding to enter into this Agreement and each Other Document to which it is a party or in taking or not taking action hereunder or thereunder.
The Documentation Agent. The Documentation Agent shall have no rights, duties, or obligations hereunder, except as specifically provided in this Agreement. The Documentation Agent (a) may voluntarily resign by notice to the Administrative Agent, the Lenders, and Borrower, and (b) shall resign upon the request of the Required Lenders for cause. Upon the resignation of the Documentation Agent, the Required Lenders may elect to designate a successor Documentation Agent (which, if no Default or Potential Default exists, is subject to Borrower's approval that may not be unreasonably withheld), which must be a Lender who is a commercial bank having a combined capital and surplus of at least $1,000,000,000.00 (as shown on its most recently published statement of condition) and whose debt obligations (or whose parent's debt obligations) are rated not less than Baa1 by Xxxxx'x or BBB+ by S & P.
The Documentation Agent the Administrative Agent and the Banks each agree to keep confidential all information obtained from any Loan Party or its Subsidiaries which is nonpublic and confidential or proprietary in nature (including any information the Borrower specifically designates as confidential), except as provided below, and to use such information only in connection with their respective capacities under this Agreement and for the purposes contemplated hereby. The Documentation Agent. Notwithstanding anything else to the contrary contained in this Agreement or any other Loan Document, the Documentation Agent, in such capacity, shall have no duties or responsibilities under this Agreement or any other Loan Document nor any fiduciary relationship with any Lender, and no implied covenants, functions, responsibilities, duties, obligations or liabilities shall be read into this Agreement or otherwise exist against the Documentation Agent, in such capacity except as are explicitly set forth herein or in the other Loan Documents.

The Documentation Agent. The Documentation Agent shall have no duties or obligations under the Loan Documents in its capacity as Documentation Agent. The Documentation Agent, in its capacity as Documentation Agent, shall have the same rights, protections, immunities and indemnities as the Administrative Agent.
