Subcontractor Selection. 11.3.1 Unless otherwise provided under this Article 11, the selection of all Subcontractors and suppliers shall be made by competitive Offers in a manner that will not encourage favoritism or substantially diminish competition. While not subject to the competitive procurement requirements of ORS Chapter 279C, the process shall conform to the following procedures, in general compliance with the open and competitive nature of public procurement, taking into account industry subcontracting practices.

Subcontractor Selection. In the event YHI permits the Contractor to contract with any third party to perform any of Contractor's obligations to YHI, Contractor must make positive efforts to use small businesses, minority-owned firms, and women-owned businesses as sources of goods and services whenever possible. To this end, Contractor must place qualified small, minority-owned, and women- owned business enterprises on solicitation lists; ensure that small, minority-owned, and women--owned business enterprises are solicited whenever they are potential sources; consider contracting with consortia of small, minority-owned, or women-owned business enterprises when an intended contract is too large for any one such firm to handle on its own or, if economically feasible, divide larger requirements into smaller transactions for which such organizations might compete; make information on contracting opportunities available and establish delivery schedules that encourage participation by small, minority- owned, and women• owned business enterprises; and use the services and assistance of the Small Business Administration and the Minority Business Development Agency, as appropriate.
Subcontractor Selection. After Construction Manager and Owner have agreed to potential bidders from the Potential Subcontractor List (the “Qualified Bidders”), Construction Manager shall solicit from such Qualified Bidders at least three (3) competitive bids or proposals for each Subcontract. If Construction Manager is unable to solicit three (3) or more competitive bids or proposals for a division of Work, Owner’s prior written approval shall be required to accept any bid or proposal for that Work.‌ If Owner approves a Prequalification Plan, Construction Manager may award Subcontracts to firms meeting the Prequalification Plan’s standards, with Owner’s prior written approval.

XXXXXXXX ANTI-KICKBACK ACT. The Contractor agrees to comply with the Xxxxxxxx Anti­Kickback Act, as amended, 18 U.S.C. 874, et seq., as supplemented in the DOL regulations 29 C.F.R. Part 3, which are hereby incorporated by reference. XXXXX-XXXXX ACT. If the Contractor performs more than $2,000 in construction, alteration, or repair services on public buildings or public works on behalf of YHI, it must comply with the Xxxxx-Xxxxx Xxx, 00 X.X.X. 0000 et seq., and implementing DOL regulations, 29 C.F.R. 5. The Xxxxx-Xxxxx Act requires contractors to pay wages to laborers and mechanics at a rate not less than the minimum wages specified in a wage determination made by the Secretary of Labor. The Xxxxx-Xxxxx Act also requires contractors to pay wages not less than once per week.
Subcontractor Selection. The Contractor’s selection of any Subcontractor must comply with ABOR Policy 3-804B(3)(h)((1)) and ((2)) and must be based on qualifications alone, or on a combination of qualifications and price selection, but shall not be based on price alone.

Subcontractor Selection. 15.1. The selection of all subcontractors shall be the sole responsibility of ESCO.
Subcontractor Selection. The Utility may perform some or all of the Work under a Task Order itself or through Subcontractors. When practical, the Utility shall competitively select Subcontractors for the purpose of determining the reasonableness of Subcontractor prices. When competition is not practical, price reasonableness may be determined by comparing proposed prices with those obtained for the same or similar work, prices published in independent cost guides, published in competitive price lists or developed by independent sources. Subcontractor selection shall be based on cost, experience, past performance, reliability, and such other factors as the Utility may deem appropriate, as long as such factors are practicably related to the Government's minimum needs. In no event may such services be provided by Subcontractors listed as excluded from Federal Procurement Programs, which list is maintained by GSA pursuant to 48 C.F.R. 9.404. For any T.O., the Utility may submit the names of proposed Subcontractors to the Government Contracting Officer to ensure they are not excluded pursuant to 48 C.F.R. 9.404.
