Special Severability Sample Clauses
The Special Severability clause ensures that if a specific provision or section of a contract is found to be invalid, illegal, or unenforceable, only that particular part is affected, while the remainder of the agreement remains in force. In practice, this clause may specify that certain key terms or obligations are so essential that, if they are invalidated, the parties may renegotiate or terminate the agreement, or it may outline a process for replacing the invalid provision with a valid one that closely reflects the original intent. The core function of this clause is to preserve the overall integrity and enforceability of the contract, even if some parts are legally problematic, thereby minimizing disruption and uncertainty for the parties involved.
