Source of Materials. 1. Design-Builder will notify the Commission Representative in writing as soon as possible after the Contract has been awarded, but not less than 3 weeks prior to the need for inspection and testing of the source (or sources) from which Design-Builder expects to obtain the various construction materials. The source of supply of each materials used will be approved by the Commission before delivery is commenced. If sources previously approved are found to be unacceptable at any time and fail to produce materials satisfactory to the Commission, the Design-Builder will furnish materials from other approved sources.

Source of Materials. All such materials be obtained from the source designated in the contract. If sources previously approved are found to be unacceptable at any time and fail to produce materials satisfactory to the Superintending Engineer the contractor shall furnish materials from other approved sources. The contractor will not be reimbursed for any expenses in developing the new source. If the contractor decides to investigate, new source of supply, he shall furnish without charge such preliminary samples as the Superintending Engineer may require. Tests musts be made on these samples by the contractor at his expenses under the directions of Superintending Engineer/and report rendered, but it is understood that such tests are for informatory purposes only. Only materials actually delivered for use will be considered and their acceptance will be based solely upon the results of the tests made on these materials. The change to the new source initiated by the contractor shall not be a ground for his demanding any compensation or extensions of time.
Source of Materials. The parties recognize that the Materials consist of a unique, proprietary and secret combination of chemicals which has been developed by NTI and which chemicals are prepared, mixed and combined prior to shipment in the form of Masterbatch; and that the Masterbatch is essential in order for the Process to work safely and effectively. Accordingly, in order to ensure proper quality control, NTI agrees to sell to the Company, at the Company’s request, and the Company agrees to purchase from NTI, such Materials and/or Masterbatch as may be necessary to carry out the Company’s Business. Alternatively, the Company may purchase Materials and/or Masterbatch from any other NTI Affiliate or external bona fide supplier, provided that NTI has approved the quality and reliability of such materials and such supplier.

Source of Materials. The DESIGN/BUILDER agrees to produce, upon request, evidence supporting the use of materials used on the work. The cost of testing materials used, or proposed for use on this work, except where required by the contract documents, will be borne by the SYSTEM. In the event that materials tested do not comply with contract requirements, the cost of initial and subsequent testing will be borne by the DESIGN/BUILDER.
