Sole Source. A Subcontractor specified by name in Construction Documents as the exclusive source from which conforming goods or services may be obtained. Designation of goods or services by reference to a named source accompanied by the qualification “or equal” or similar language is not a designation of a Sole Source as that term is defined herein.
Sole Source. Notwithstanding the requirements of Section 4.01(c) above, the City may, in its sole and absolute discretion, authorize Funding Recipient to procure Equipment and/or the necessary related services on a sole source basis from a vendor identified by Funding Recipient who otherwise constitutes an Eligible Vendor, if only such vendor is capable of supplying the requisite Equipment or services and the Equipment to be provided thereby constitutes Eligible Equipment. In such instances, Funding Recipient shall provide the City with such information regarding the selection of the vendor in question as the City shall require.
Sole Source. AVID Center affirms that it is the sole source of the AVID College Readiness System to which competition is precluded due to the existence of a patent, copyright, secret process, or monopoly. AVID Center's sole source development includes intellectual property - copyrights and trademarks - in the AVID Materials, licensing for reproduction of student activity sheets associated with the curriculum, technical assistance, training to teachers and administrators, and coordination of the AVID College Readiness System through consultation, data collection and certification processes.
Sole Source. Advanced BioHealing shall not during the term of the Agreement contract with any alternative supplier to purchase products comparable to Mesh for the purpose of using such comparable mesh in the manufacture of Dermagraft for commercial sale.
Sole Source. If requested by Illumina, the Parties will discuss any commercially reasonable ways to minimize any negative impact caused by CareDx’s activities on Illumina’s ability to represent to other purchasers of its products that Illumina is the sole source of such products.

Nothing in this Agreement will prevent Maxtor from procuring Products or the same or substantially similar goods or materials from other sources than Seller or from providing the same itself, provided that the confidentiality and intellectual property rights terms of this Agreement are not breached.
