Software Use Restrictions. Except as expressly authorized pursuant to Section 2, Client may not and may not permit others to: (1) Use the Software on or gain access to the Materials, Software, Content and/or Documentation from more than one machine at a time, nor install them in a fashion that makes the Materials, Software, Content and/or Documentation available on, running on or access from more than one machine at a time unless Client has paid the additional fee(s) and any other charges imposed by Wellovate for such use or access; (2) Sell, rent, lease, license, sublicense, or assign the Materials, Software, the Content and/or the Documentation, or the use of the Materials, Software, the Content and/or the Documentation to others; (3) Transfer the Materials, the Content and/or the Documentation or any copy thereof to another party. (4) Reverse engineer, decompile, disassemble, or otherwise derive the source code from the Software; (5) Alter, modify, adapt, reconfigure, or prepare derivative works of the Materials, Software, the Content and/or the Documentation; (6) Provide or permit access to the Materials, Software, the Content and/or the Documentation except for the sole use of Client; (7) Archive or retain any of the Materials, Software, the Content and/or the Documentation in any form without the written permission from Wellovate; (8) Distribute (including via e-mail or the Internet), or otherwise make available, copies of the Materials, Software, the Content and/or the Documentation to others, whether or not for payment or other consideration, without the written permission from Wellovate. Requests for permission to retain, distribute or reproduce may be submitted to Wellovate at its regular business address; (9) Copy, extract, summarize, distribute or otherwise use the Materials, Software, the Content and/or the Documentation in any manner which competes with or substitutes for Wellovate’s distribution of the Materials, Software, the Content and/or the Documentation to its customers.

Software Use Restrictions. Atheros Use of Atheros software is limited to evaluation and demonstration only. Permitted distributions must be similarly limited. Further rights must be obtained directly from Atheros. ATI (AMD) Distribution of ATI software must be a part of, or embedded within, Authorized Systems that include a ATI graphics processor core. Broadcom Corporation Your use of Broadcom Corporation software is restricted to Authorized Systems that incorporate a compatible integrated circuit device manufactured or sold by Broadcom. Cirque Corporation Use of Cirque Corporation technology is limited to evaluation, demonstration, or certification testing only. Permitted distributions must be similarly limited. Further rights, including but not limited to ANY commercial distribution rights, must be obtained directly from Cirque Corporation. Coding Technologies (Dolby Labs) Use of CTS software is limited to evaluation and demonstration only. Permitted distributions must be similarly limited. Further rights must be obtained from Dolby Laboratories. CSR Use of Cambridge Silicon Radio, Inc. (“CSR”) software is limited to evaluation and demonstration only. Permitted distributions must be similarly limited. Further rights must be obtained directly from CSR. NXP Wireless Charging Library License to the Software is limited to use in inductive coupling or wireless charging applications Global Locate (Broadcom Corporation) Use of Global Locate, Inc. software is limited to evaluation and demonstration only. Permitted distributions must be similarly limited. Further rights must be obtained from Global Locate. Imagination Technologies Limited (IMG) If the Licensed Software includes proprietary software developed by IMG, your rights are limited to a non-exclusive, world-wide right and non- transferrable and non-sub-licensable license (i) to use and modify the Licensed Software and documentation and (ii) to copy and distribute the Licensed Software only in object code form solely for use on NXP Rayleigh products. If you are provided with the Licensed Software in source code format, you are restricted to accessing only those deliverables in source code format which are necessary for you to carry out either specific customization or porting work in association with NXP’s Rayleigh products or your Authorized System. Software Use Restrictions. In consideration for your acceptance of the terms and conditions of this Agreement and your payment of the license fees described in our invoice, Actify grants to you (or, if you will use the Software as an employee of a company, your employer) a non-transferable and non-exclusive right to use and execute the Software on a single computer, without right to sublicense or distribute the Software (except as provided in SLA Section 3 below). Under no circumstance may you store, use or allow the use of the Software in any manner on more than one computer at one time. However, you may use remote access technologies, such as the Remote Desktop features in Microsoft Windows or NetMeeting, to access and use your licensed copy of the Software, provided that only the primary user of the device hosting the remote desktop session accesses and uses the Software with a remote access device. These remote desktop rights do not permit you to use the Software on both the device hosting the remote desktop session and the access device at the same time. You may also permit any device to access and use your licensed copy of the Software for the purpose of providing you with technical support and maintenance services. You agree that Actify has the right to audit to verify that the number of computers running the Software corresponds with the number of licenses paid for. You agree that you will not modify, reverse engineer, decompile or disassemble any portion of the Software.

Software Use Restrictions. Any use by Licensee of CRYSIS WARHEAD not expressly permitted in Section 2 above is expressly prohibited and any such unauthorized use shall constitute a material breach of this Agreement by Licensee. This prohibition includes (but is not limited to): - to copy, reproduce, manufacture or distribute (free of charge or otherwise) CRYSIS WARHEAD, in whole or in part, in any media; - to transfer, sell, sublicense or lease any rights in and to CRYSIS WARHEAD to third parties; - to use CRYSIS WARHEAD contrary to morality or applicable law; - to modify CRYSIS WARHEAD or create any derived work (except as pursuant to the SANDBOX 2 EDITOR for CRYSIS WARHEAD or MOD SDK for CRYSIS WARHEAD Agreements) - decompile, reverse engineer or disassemble CRYSIS WARHEAD. Licensee shall not alter or remove any legal notices, such as trademark and copyright notices, affixed by CRYTEK on or within CRYSIS WARHEAD.

Software Use Restrictions. Customer may not, nor may it authorize any other person to, (i) obscure, remove, or alter any proprietary markings, designations, or notices in or on the Software Services or Documentation; (ii) reconfigure, reverse-engineer, disassemble, decompile, discover the source code of, prepare any derivative works of, update, combine with other computer code, or otherwise modify the Software Services or Documentation; (iii) develop, assist in developing, or have developed on its any other person’s behalf software or services that compete with or are substantially similar to the Software Services; (iv) commercially exploit the Software Services or Documentation; or (v) use the Software Services for unlawful purposes.

Software Use Restrictions. You acknowledge that any software and related documentation that may be available to download from the Site (the "Software") is a copyrighted work owned or licensed by a ▇▇▇▇▇▇.▇▇▇ Party (as defined herein), and that you do not acquire any ownership rights by downloading the software. You agree that your use of the Software is governed by the terms of the license agreement that accompanies or is included with the Software (the "License Agreement"). Except as set forth in the applicable License Agreement, any further copying, reproduction or redistribution of the Software is expressly prohibited.

You are prohibited from using the Software for any commercial purpose, including but not limited to operating gaming centers, charging others for access, or incorporating the Software into commercial products or services without express written consent from Talus or Rugged Club, LLC. Additionally, you may not rent, lease, lend, sell, redistribute, or sublicense the Software to any third party, nor may you use the Software to develop competing products or services.

Software Use Restrictions. Software available for downloading from this Site (the “Software”) is the copyrighted and database righted work of E-Sign (UK) ltd Use of the Software is governed by the terms of the end-user license associated with the software (“License”). An end user agrees to the License by installing, copying, or using the Software. Redistribution of the Software is expressly prohibited by law, and may result in civil and criminal penalties. Comments, feedback, information or materials submitted to E-Sign (UK) ltd in association with the E-Sign service (“Submissions”) shall be considered non-confidential and E-Signs property. By providing Submissions to E-Sign, you agree to assign to E-Sign, at no charge, all worldwide intellectual property rights to the Submissions. E-Sign shall have unrestricted use of the Submissions. You acknowledge that you are responsible for the Submissions that you provide and that you have full responsibility for the legality and copyright of the submissions.
