Section 27. 3 Recall Employees who are laid off will be placed on a recall list for a period equal 11 to their seniority at the effective date of the layoff. Recall from layoff will be made in reverse order 12 of layoff, that is, the last employee placed on layoff will be the first to be recalled. Employees shall 13 be given fourteen (14) calendar days advance notice of recall and such notice shall be sent by 14 certified mail to the employee's last address on record. Employees shall have five (5) calendar days 15 to accept or reject the Employer's offer of recall. Employees rejecting recall or failing to report to 16 work on the effective date of the recall shall lose all seniority and rights of recall.
Section 27. 2 5 All drug screening tests shall be conducted by medical laboratories meeting the standards of the 6 National Institute of Drug Abuse and the National Institutes of Health. No test shall be 7 considered positive until it has been confirmed by a gas Chromatography/Mass Spectrometry full 8 scan test or its equivalent. The procedures utilized by the Employer and testing laboratory shall 9 include an evidentiary chain of custody control. All samples collected shall be contained in two
Section 27. Section 2.7 of the Credit Agreement is hereby deleted in its entirety and replaced with the following:
Section 27. 4 21 Postdoctoral Scholars working on the Seattle Campus will have access to Husky Night 22 Walk and UW Night Ride services in accordance with University policies. 24 Section 27.5 25 The Employer will provide Postdoctoral Scholars with a fully subsidized U-PASS. 26 Maintenance of this benefit is subject to UW Transportation Service requirements.
Section 27. 6 29 If a Postdoctoral Scholar’s designated work location does not haveprovide access to 30 shower facilities, upon the request of the Postdoctoral Scholar, access to shower 31 facilities may be granted at a nearby UW-controlled building that has shower facilities.

Section 27. Section 27 of the Rights Agreement is hereby amended by adding the following paragraph at the end thereof: “Notwithstanding anything in this Agreement to the contrary, the limitations on the ability of the Board of Directors to amend this Agreement set forth in this Section 27 shall not affect the power or ability of the Board of Directors to take any other action that is consistent with its fiduciary duties under Delaware law, including without limitation accelerating or extending the Expiration Date or making any other amendment to this Agreement that is permitted by this Section 27 or adopting a new stockholder rights plan with such terms as the Board of Directors determines in its sole discretion to be appropriate.”
