SDS. Where necessary, Seller will furnish Buyer with Safety Data Sheets (“SDS”), which include health, safety, security and environment (“HSSE”) information on Product consistent with regulatory requirements. Buyer will comply with all applicable Laws concerning the availability and use of the Product SDS and Buyer will disseminate appropriate HSSE information to all persons (including but not limited to Buyer’s employees, contractors and customers) as required by applicable law or which Buyer foresees may be exposed to Product. When Buyer further processes, mixes or incorporates the Product into another material, resells, exchanges and/or transfers or otherwise deals with the Product, Buyer agrees to develop and use its own branded SDS and certificates of analysis consistent with the regulatory requirements of the jurisdiction(s) in which Buyer markets the Product, and Buyer shall not use any of Shell’s trademarks, the Shell name, Shell contact numbers and emergency numbers or the Shell Branded SDS on the Buyer’s SDS or certificates or analysis for the Product without obtaining the prior express written consent of Seller. Buyer will take reasonable steps to obtain obligations similar to those in this paragraph from its customers to whom it sells the Products.

SDS. The monthly usage of the SDS by the Coker Complex (the "Monthly SDS Allocation") shall equal (i) 47.7 (which is the total number of acres occupied by the Coker Complex), divided by (ii) 2300 (which is the ---------- total number of acres drained by Clark R&M's pump house no. 15 located at the Refinery).
SDS. Seller shall provide Safety Data Sheets for the Marine Fuels sold under this Agreement through its website: xxxx://xxx.xxxxxxxxx.xxx/client-login/?wlfrom=%2Fclient-downloads%2F. Xxxxx agrees to visit the website and obtain a copy of the appropriate SDS Sheet. Buyer shall disseminate the information so as to warn of possible hazards to all persons whom Buyer can reasonably foresee may be exposed to the hazards including, without limitation, Buyer’s employees, agents, contractors, and customers. Xxxxx agrees to defend, indemnify, and hold harmless Seller against all liability arising out of or in any way connected with its failure to properly disseminate the warnings and information including, without limitation, liability for injury, sickness, death, and property damage.
SDS. To the extent required under applicable law, Seller shall provide Buyer with Safety Data Sheets (“SDS”), which the parties acknowledge are available at xxx.xxx.xxxxx.xxx, and shall provide the receiving vessel with SDS appropriate to the Marine Fuels delivered. Buyer shall ensure that its employees, agents and contractors comply with the obligations, requirements and recommendations relating to the handling and use of the Marine Fuels.
SDS. 1.01 Provide the updated FEPs: Disruptive Events AMR. DOE will provide the updated FEPs AMR to the NRC. Expected availability is January 2001.
SDS. 1.02 Consistent with proposed 10 CFR Part 63, the NRC believes the use of the mean is appropriate, however, DOE may use any statistic as long as it is consistent with site data and technically defensible. DOE will either provide technical justification for use of median values or another statistical measure, such as the mean, or will evaluate and implement an alternative approach. The DOE-proposed approach and its basis will be provided to NRC prior to September 2001. The approach will be implemented prior to any potential LA.
SDS. 2.01 Regarding ground motion, provide documentation, or point the NRC to the documentation on the expert elicitation process, regarding the feedback to the subject matter experts following the elicitation of their respective judgements. DOE will provide documentation demonstrating the adequacy of the elicitation feedback process by December 2000.

SDS. 2.04 The approach to evaluate seismic risk, including the assessment of seismic fragility and evaluation of event sequences is not clear to the NRC, provide additional information. DOE believes the approach contained in the FEPs AMR will be sufficient to support the Site Recommendation. The updated FEPs AMR is expected to be available in January 2001.

SDS. 3.03 The NRC needs to review the Fracture Geometry Analysis for the Stratigraphic Units of the Repository Host Horizon AMR. The NRC will provide feedback and proposed agreements to DOE, if needed, by December 2000.
