Required Use. It will use its Project property continuously and appropriately throughout the useful life of that property;
Required Use. Nothing in this Agreement is intended, nor shall be construed, as preventing either Sub-Adviser (or its affiliated person) or Adviser, the Trust or the Fund from using the names of Sub-Adviser, Adviser, the Trust or the Fund in responses to regulatory examinations, inspections or inquiries, or subpoenas or other compulsory legal process.
Required Use. Uniforms must be worn by all employees receiving clothing allowance during regular working hours. If the employee does not wear a uniform, the allowance will be forfeited either in present year or in the next year.
Required Use. During the term of this Agreement, following the date of Completion of Construction of the Improvements and continuing thereafter for a period of at least five (5) years thereafter the Improvements shall not be used for any purpose other than the Required Use, and the operation and occupancy of the Improvements in conformance with the Required Use shall not cease for more than thirty (30) days, except in connection with and to the extent of an event of Force Majeure.
Required Use. 6.1 The Tenant must not use the Premises for any purposes except the Required Use.
Required Use. WPZS shall use and continuously occupy the Property during the Term solely for the operation of a public zoological gardens and related and incidental purposes and programs, including but not limited to conservation, education, enterprise operations, and visitor services, in accordance with this Agreement and the Long- Range Plan, and for no other purpose. Notwithstanding the foregoing, the parties intend that: a) the Woodland Park Rose Garden; and b) the two neighborhood parks on the Premises, one at 50th and Xxxxxxx, and the other at 59th and Xxxxxxx (the “Neighborhood Parks”), not be programmed for Zoo purposes. WPZS shall maintain and operate the Woodland Park Rose Garden and the Neighborhood Parks as they are being used and/or utilized on the Effective Date of this Agreement, provided that the Parks Department will have responsibility for the maintenance and upkeep of the children’s’ play area in the park at 59th and Xxxxxxx. The Parks Department retains the right to determine the uses of the Woodland Park Rose Garden and the Neighborhood Parks, provided that any change in such uses shall be adopted as part of the Long-Range Plan or by amendment of the Long-Range Plan. Additionally, the water standpipe on the western perimeter of the Zoo will continue to be managed pursuant to the legislation establishing the standpipe and authorizing its location on Department of Parks and Recreation Park property.
Required Use. The Lessee may only use the Land and the Lessee’s Building for the Required Use. The Lessee may not change the Required Use without the written consent of the Council in its capacity as land owner. The consent of the Council under this clause may be granted or withheld at its absolute discretion or may be given subject to conditions including a condition relating to the level of rent payable.
Required Use. The Boys and Girls Club shall use the Property for the purpose of conducting all of the required activities set forth in Exhibit B, Description of Required Uses and for no other purpose. The Boys and Girls Club shall not change the type of use of the Premises or discontinue any of the Required Uses of the Premises without obtaining the prior written consent of the City, which may not be unreasonably withheld. The foregoing notwithstanding, the Boys and Girls Club in its possession, use and occupancy of the Property agrees to observe and comply with all restrictions, laws and ordinances affecting the Property and the Building or occupancy thereof. The Boys and Girls Club further agrees that no use shall be made of the Property which will cause cancellation of any insurance policy covering the Property or the Building.
Required Use. During the term of this Agreement following the Commencement Date and continuing thereafter until the Expiration Date, Laredo EPC Economic Development Agreement TM 64092 Page 16 of31 the Project shall not be used for any purpose other than the Required Use, and the operation and occupancy of the Project in conformance with the Required Use shall not cease for more than thirty (30) days, except in connection with and to the extent of an event of Force Majeure, or remodeling (provided such remodeling shall not exceed ninety (90) days in the aggregate in any five (5) year period.
