Request for Clarification. Any of the parties may request, within fifteen (15) days as from the notification date of the award, its clarification of the award. The Arbitration Tribunal shall resolve on the request for clarification within fifteen (15) days as from its filing. Clarifications shall be given by the Arbitration Tribunal rendering the award. Should the Arbitration Tribunal consider that circumstances so require, it may postpone the enforcement of the award until it resolves the request submitted.
Request for Clarification. The Contractor may request that the Province agree that a particular design element or construction specification complies with the Project Requirements, and if the Province so agrees then such design element or construction specification shall be deemed to comply with the Project Requirements. However, the Province must consider such a request only where:
(a) the request is in relation to a specific design element or construction specification;
(b) the pertinent Project Requirements are capable of differing interpretations in relation to the specific design element or construction specification;
(c) the Contractor has established that it would be exposed to significant risk of material expense or delay if its interpretation of the pertinent Project Requirements ultimately proved to be incorrect; and
(d) the Contractor has not made multiple or generalized requests under this Section such that in the reasonable opinion of the Province the Contractor is attempting to use this Section to transfer to the Province all or partial responsibility for ensuring that the Project meets the Project Requirements.
Request for Clarification. 1. Each State Party shall have the right to request another State Party for clarification concerning any situation which may be considered ambiguous or which may give rise to doubts about the compliance of that State Party with this Treaty. It shall inform the Executive Committee of such a request. The requested State Party shall duly respond by providing without delay the necessary information and inform the Executive Committee of its reply to the requesting State Party.
2. Each State Party shall have the right to request the Executive Committee to seek clarification for another State Party concerning any situation which may be considered ambiguous or which may give rise to doubts about compliance of that State Party with this Treaty. Upon receipt of such a request, the Executive Committee shall consult the State Party from which clarification is sought for the purpose of obtaining the clarification requested.
Request for Clarification. Any Bidder who finds discrepancies in, or omissions from, any provision of the ITB, Specifications, or Contract Documents, or has doubt as to the meaning, shall make a request for clarification in writing, to the OETC Contract Administrator listed on Page 2 of the ITB. To be considered, the request for clarification must be received no later than seven (7) calendar days prior to the Bid Closing Date.

Request for Clarification. Any Party may request clarification from the Company on the calculation of the Purchase Price Adjustment Amount, within thirty (30) days after receipt of the Price Adjustment Documents, detailing the items and amounts subject to the request for clarification (“Request for Clarification”). The Company will have thirty (30) days to respond to the Request for Clarification and provide the requested clarifications (“Clarifications”).

12.9 Tdh also reserves the right to visit the premises and examine the fleet of the bidders whose bids have been pre-selected before making the final selection. This step may have an impact on the decision of the evaluation committee if the capacity of the bidder is not considered adequate or compatible with that indicated in the tender documents.

However, the Province must consider such a request only where:
(a) the request is in relation to a specific design element or construction specification;
(b) the pertinent Project Requirements are capable of differing interpretations in relation to the specific design element or construction specification;
(c) the Contractor has established that it would be exposed to significant risk of material expense or delay if its interpretation of the pertinent Project Requirements ultimately proved to be incorrect; and
(d) the Contractor has not made multiple or generalized requests under this Section such that, in the reasonable opinion of the Province, the Contractor is attempting to use this Section to transfer to the Province all or partial responsibility for ensuring that the Project meets the Project Requirements.
Request for Clarification. If a responder discovers any significant ambiguity, error, conflict, discrepancy, omission, or other deficiency in the RFB, it shall immediately notify the Acquisition Management Specialist in writing, as specified in the introduction, of such error and request modification or clarification of the document.
