Refuse Removal. 9.1 The removal of refuse shall be under the control of the HOA who may, in exercising its function in this regard, from time to time by notice in writing to all persons concerned:
9.1.1 Lay down the type and size of refuse containers to be used
9.1.2 Give directions in regard to the placing of such containers for collection
9.1.3 Require the payment of a reasonable charge for the provision of containers.
9.2 Property owners are to ensure that directions given relating to refuse removal are observed.
9.3 Removal of refuse of such size, quantity or nature that it cannot be accommodated by the normal service shall be the responsibility of the Property Owner.

If any tenant shall elect to, or is required by Landlord or governmental authority to have additional trash removal service, such tenant shall pay for all such charges so incurred and to the extent that trash removal services are provided through Landlord and charged to all tenants, Landlord shall be entitled to charge the tenants requiring such special services the amount thereof which shall be applied to reduce the total amount of such trash removal costs before apportionment and determination of Tenant’s share thereof.
