Railways. The Proponents may in accordance with approved proposals use rail or road or rail and road transport for the carriage of inputs necessary for the Project and of finished products, partly finished products and waste products of the Project between the Mine Sites the Plant Sites and the port used from time to time for the imports and exports required for the Project. Any requirement in respect of rail transport contained in approved proposals is referred to in this Clause as “the Proponents’ rail transport requirements”.
Railways. (1) Subject to the by-laws made under the Government Railways Act, 1904, (insofar as those by-laws are not inconsistent with this Agreement) and subject to the provisions of this Clause the Company shall consign at its own risk, and the State shall cause the Railways Commission to transport, by rail, all the Company’s requirements of —
(a) ore and nickel-containing products from the railhead at ▇▇▇▇▇▇▇ to the plant site of Lake View and Star Limited at Fimiston or to any other processing plant in the vicinity of Kalgoorlie approved by the Minister; and
(b) nickel-containing products from Fimiston or ▇▇▇▇▇▇▇ to Esperance or such other port as may be approved hereunder.
(2) The Company shall from time to time as required by the Railways Commission pay to the State a sum or sums to be agreed between the parties towards the cost of upgrading or reconstructing the existing railway line between ▇▇▇▇▇▇▇ and Kalgoorlie in narrow gauge (3 feet 6 inches) in accordance with proposals from time to time approved under Clause 5 (including the cost of providing inter alia any deviations, loops, spurs, sidings, crossings, points, bridges, and other works and appurtenances) to achieve a capacity to enable the Railways Commission to transport ore or nickel concentrates at a rate not exceeding seven hundred thousand (700,000) tons per annum and all other rail freight required by the Company for its operations hereunder for a period of five (5) years from the date on which rail haulage of the Company’s ore or nickel concentrates commences.
(3) Not later than eighteen (18) months after the date of commencement of haulage of ore referred to in subclause (2) of this Clause the Company shall give notice to the State of its estimated future rail transport requirements hereunder (including provisional annual tonnages) of ore and nickel-containing products.
(4) On receipt of the notice referred to in subclause (3) of this Clause the State shall cause the Railways Commission in consultation with the Company to prepare a specification (including all necessary plans and bills of quantities) of the works required to further upgrade or reconstruct the existing ▇▇▇▇▇▇▇ to Kalgoorlie railway line in narrow gauge (3 feet 6 inches) to enable the Railways Commission to transport the Company’s rail freight to the extent specified and in accordance with the said notice.

At any time after the commencement date the Company may give notice to the State that it requires the construction of a railway from the crushing plant in the next following clause mentioned to the boundary of the works site and upon receipt of such notice the State shall if the making of the railway has then already been authorised by the said Parliament forthwith commence to construct and as soon as conveniently may be and in any event within two years after such receipt will complete and will thereafter so long as the Company uses the railway as contemplated by this agreement will provide funds for the operation and maintenance of a 3 feet 6 inches or wider gauge single railway (hereinafter called “the direct railway”) from the said crushing plant to the works site following generally the route of the proposed railway appearing in the Plan commonly known as the ▇▇▇▇▇▇▇▇▇▇ Plan from Mundijong to Kwinana. If the making of the direct railway has not already been so authorised the State will seek the authority of the said Parliament thereto and forthwith after the authority is given will commence and thereafter will complete the railway as aforesaid.
Railways. CHAPTER I. CLAUSES RELATING TO INTERNATIONAL TRANSPORT. ARTICLE 365. Goods coming from the territories of the Allied and Associated Powers, and going to Germany, or in transit through Germany from or to the territories of the Allied and Associated Powers, shall enjoy on the German railways as regards charges to be collected (rebates and drawbacks being taken into account), facilities, and all other matters, the most favourable treatment applied to goods of the same kind carried on any German lines, either in internal traffic, or for export, import or in transit, under similar conditions of transport, for example as regards length of route. The same rule shall be applied, on the request of one or more of the Allied and Associated Powers, to goods specially designated by such Power or Powers coming from Germany and going to their territories. International tariffs established in accordance with the rates referred to in the preceding paragraph and involving through waybills shall be established when one of the Allied and Associated Powers shall require it from Germany.
Railways. (1) Before the end of the year 1968 the State shall construct and thereafter so long as the Company uses the line as contemplated by this Agreement the State shall operate and maintain a standard gauge line from a point or points reasonably practicable and mutually agreed upon at or near and servicing the Company’s storage bins established on the leased areas to the works site via Southern Cross and Cannington in the said State. The State will if requested by the Company construct and maintain at the cost of the Company on the leased areas such loops spurs and sidings as may be mutually agreed in order to assist in the efficient loading and transport of the ore.
(2) Subject to the giving by the Company to the State of reasonable notice from time to time the State shall also provide and maintain efficient locomotives and ore wagons in sufficient numbers for the purposes of this Agreement and the crews to operate them and will also transport by rail during the continuance of this Agreement all the ore mined from the leased areas and required by the company to be transported to the works site provided that the loading and unloading of ore wagons shall be the responsibility of the Company.
(3) Subject to the three (3) years’ notice in writing being given by the Company to the State the State will within that period at its expense extend its standard gauge line to a point or points reasonably practicable and mutually agreed upon at or near the Company’s storage bins at another point or points on the leased areas. If requested by the Company the State will construct and maintain at the cost of the Company on the extended line such further loops spurs and sidings as may be mutually agreed in order to assist in the efficient loading and transport of the ore.
(4) For a period of not less than thirty (30) years from the production date or unless and until the parties hereto shall otherwise in writing mutually agree the Company shall use only the rail facilities contemplated by this Clause for the transport of iron ore from the leased areas to the works site and in respect of such transport the Company shall pay to the State in respect of each financial year freight charges based upon the total tonnage of iron ore transported as aforesaid in that year as set out in the first column of the Schedule to this Clause and the rates per ton mile set out in the second column of such Schedule.

Without prejudice to its proprietary rights over the railways within its boundaries and its control of the railway administration, the Free Territory may negotiate with Yugoslavia and Italy agreements for the purpose of ensuring the efficient and economical operation of its railways. Such agreements would determine where responsibility lies for the operation of the railways in the direction of Yugoslavia or Italy respectively and also for the operation of the railway terminal of Trieste and of that part of the line which is common to all. In the latter case such operation may be effected by a special commission comprised of representatives of the Free Territory, Yugoslavia and Italy under the chairmanship of the representative of the Free Territory.

Railways i) The necessary space for keeping of materials and for changing of uniforms by contractors service staff will be provided, but covered accommodation will be given subject to availability. In case open land space is given, contractor to erect temporary shelters as per Railway standards with his own cost for stores and staff rooms.
ii) Electricity and water will be provided by Railways, free of cost at nearest available place. Contractor to make arrangements to carry the power or water to the place of work.

iv) To replace defective lights / fans / mobile charging inverters / batteries / switches / fuses etc., new items to be collected from Railway stores and released items should be supplied to stores for accountal purpose.
v) In case any en-route observation is to be made on the functioning of the batteries, fans &lights, necessary authority letter shall be issued to the Contractor’s service engineer by the nominated supervisor / officer incharge. However this letter is not a travel authority & the service engineer has to travel only with a valid ticket.
vi) Records to maintain for the work done as per schedules by the Railways:
A. Monthly planning by depot incharge:
(i) Date wise and train wise forecast of the month for no. of coaches for daily trip schedule in the depot; one A4 size paper can contain the details for 10-12 trains. (Annexure ‘M’ in Annexure–V (Terms and conditions)).
(ii) Date wise, train wise and shift wise forecast of the month for no. of coaches for which FNE to be done (Annexure ‘N’ in Annexure–V (Terms and conditions)). One A4 sheet can contain the details for 10-12 trains.
(iii) Date wise, train wise and shift wise forecast of the month for no. of coaches for which monthly to be done (Annexure ‘O’ in Annexure–V (Terms and conditions)). One A4 sheet can contain the details for 10-12 trains.
B. Daily planning by depot incharge:
(i) The depot supervisor should furnish the details, train wise and coach number wise, for which FNE & monthly schedule is to be carried out, one day in advance to the contractor so that sufficient manpower is arranged. (Annexure- ‘P’ in Annexure–V (Terms and conditions)).
