PARTNER TRANSACTIONS. 3.1 The terms of this Master Subscription Agreement (excluding terms relating to delivery of and payment for the Dynatrace Offering) and the applicable Platform Usage Terms (together, the “Resale End-User Terms”) govern the use of any Dynatrace Offering by or for the benefit of an End-User. By its use of the Dynatrace Offering, such End-User agrees to and is bound by the Resale End-User Terms, which are incorporated by reference into the contract for such resale transaction as if such End-User was a Customer hereunder. Dynatrace LLC is, and both End-User and Partner hereby acknowledge and appoint Dynatrace LLC as, a third-party beneficiary of the Resale End-User Terms. Dynatrace is entering into this Agreement in reliance on its status as a third-party beneficiary to the Resale End User Terms between Customer and the End User, and Dynatrace shall be entitled to enforce the Resale End User Terms directly against the End User. Dynatrace is not responsible for any acts, omissions, products or services provided by Partner. Partner is not authorized to modify the Resale End-User Terms or make any commitment for Dynatrace, and Dynatrace is not bound by any obligations to End-User other than as set forth in the Resale End-User Terms.
PARTNER TRANSACTIONS. Where Licensee acquires Licensed Software or receives maintenance, support or services from a Partner, any specific term regarding warranty, maintenance and/or services, as applicable, may be contracted directly between Licensee and that Partner and conflicting terms of this Agreement shall not apply to such Licensed Software, maintenance, support or services.
PARTNER TRANSACTIONS. If you order our services from a Domo reseller or other authorized partner, the terms of this Agreement apply to your receipt and use of the services. If you do not accept the terms of this Agreement, then you must not use, or must immediately cease using, the relevant services.

The Partner may not grant Customer any rights beyond those granted to them by Dynatrace itself. Dynatrace is not responsible for any acts, omissions, or other products or services provided by Partner. Partner is not authorized to modify the Resale Terms or make any further commitment for Dynatrace, and Dynatrace is not bound by any obligations to Customer with respect to any Dynatrace Offering acquired from a Partner other than as set forth in the Resale Terms.
PARTNER TRANSACTIONS. The Dynatrace End-User Terms govern the use of any Dynatrace Offering purchased by an end-user in a resale transaction authorized by Dynatrace (an “End-User”). By its use of the Dynatrace Offering, such End-User agrees to and is bound by the Dynatrace End-User Terms, which are incorporated by reference into the contract for such resale transaction as if such End-User was a Customer hereunder. Dynatrace LLC is, and End-User acknowledges Dynatrace LLC as, a third-party beneficiary of this Agreement.
PARTNER TRANSACTIONS. These Dynatrace End-User Terms (with the exception of terms relating to delivery of and payment for the Dynatrace Offering) govern the use of any Dynatrace Offering purchased by an end-user in a resale transaction authorized by Dynatrace (an “End-User”). Bythe GSA Schedule Contract holder and the Ordering Activity executing this agreement in writing, such End-User agrees to and is bound by these Dynatrace End-User Terms. Partners and federal government end-users acknowledge and agree that Dynatrace Offerings are “commercial items” as defined in Federal Acquisition Regulation (FAR) 2.101, and that any agreement between Dynatrace and Customer is a commercial-item contract governed by FAR 12.212 and FAR Clause 52.227-14.
