Ottawa. No practices or customs shall become binding upon the employer unless reduced to writing and agreed to by the Association and the employer. Where a Board of Arbitration determines that a nurse has been disciplined without just cause, the Board may vary or set aside the penalty for the discipline as the Board deems reasonable. The parties may, by written agreement, substitute a sole arbitrator for the Board of Arbitration and the Arbitrator shall possess the same powers and be subject to the same limitations as a Board of Arbitration. Saturdays, Sundays and paid holidays as set out in this Agreement will not be counted computing the time within which any action to be taken or completed under the provisions of the Grievance and Arbitration procedures.
Ottawa. The parties shall appoint a Joint Consultation Committee consisting of two (2) employee representatives and two (2) management representatives.
