OPEN SOURCE COMPONENTS. The DS Offerings may include open source components. Whenever notices (such as acknowledgment, copies of licenses or attribution notice) are required by the original licensor, such notices are included in the Documentation of the DS Offerings. Moreover, some open source components may not be distributed and licensed under the terms of the Agreement but under the terms of their original licenses as set forth in the Documentation of the DS Offerings themselves. Source code for open source software components licensed under terms and conditions that mandate availability of such source code is available upon request. Except for components mentioned in the section EXCLUSIONS below, the warranty and indemnification provided by DS under the Agreement apply to all open source software components and shall be provided by DS and not by the original licensor, but only for the use of the DS Offerings that is in compliance with the terms of the Agreement, and in conjunction with the DS Offerings. The original licensors of said open source software components provide them on an “as is” basis and without any liability whatsoever to Customer.

Notwithstanding the license grant set forth in Section 1, You acknowledge that certain components of the Software may be Open Source Components. Licensor shall provide a list of Open Source Licenses for a particular version of the Software in the Software user documentation. To the extent required by the licenses covering Open Source Components, the terms of such licenses will apply in lieu of the terms of this Agreement. To the extent the terms of the licenses applicable to Open Source Components prohibit any of the restrictions in this Agreement with respect to such Open Source Component, such restrictions will not apply to such Open Source Component. To the extent the terms of the licenses applicable to Open Source Components require Licensor to make an offer to provide source code of Open Source Component in connection with the Product, such offer is hereby made. YOU ACKNOWLEDGE THAT LICENSOR IS NOT THE AUTHOR, OWNER OR LICENSOR OF ANY OPEN SOURCE COMPONENT, AND THAT LICENSOR MAKES NO WARRANTIES OR REPRESENTATIONS, EXPRESS OR IMPLIED, AS TO THE QUALITY, CAPABILITIES, OPERATIONS, PERFORMANCE OR SUITABILITY OF ANY OPEN SOURCE COMPONENT.
OPEN SOURCE COMPONENTS. To the extent the Supporting Material includes open source licenses, such licenses shall control over this Agreement with respect to the particular open source component. To the extent Supporting Material includes the GNU General Public License or the GNU Lesser General Public License: (a) the software includes a copy of the source code; or (b) if you downloaded the software from a website, a copy of the source code is available on the same website; or (c) if you send HPE written notice, HPE will send you a copy of the source code for a reasonable fee.
OPEN SOURCE COMPONENTS. Customer acknowledges that certain software components of the Deliverables may be covered by Open Source Licenses (“Open Source Components”). To the extent required by the Open Source License for any Open Source Components, the terms of such licenses will apply to such Open Source Components in lieu of the terms of this Agreement. To the extent the terms of the Open Source License applicable to Open Source Components prohibit any of the restrictions in this Agreement with respect to such Open Source Component, such restrictions will not apply to such Open Source Component. Tricentis shall provide Customer with a list of Open Source Components upon Customer’s request.
OPEN SOURCE COMPONENTS. Certain portions of the Software contain open source software ("Open Source Components") that are licensed under the terms of the applicable open source licenses (“Open Source Licenses”). You are bound by and shall comply with the Open Source Licenses. A listing of the Open Source Components, and links to the Open Source Licenses, can be found in the Documentation. You may reference the applicable Product’s Open Source Notices and Software Acknowledgments document at xxxx://xxxx0.xxx. To the extent the terms of the Open Source Licenses require us to make available to you the corresponding source code and/or modifications (the "Open Source Code"), you may obtain a copy of the applicable Open Source Code from its current location at xxxxx://xxxxxxxxx.x0.xxx, or by sending us a written request with your name and address to the notice address specified in Section 13(b). All requests should identify: the Open Source Code that you are requesting, the applicable Software (and any available version information) that you have licensed from us in connection with the requested Open Source Code, your email contact information, and the postal address for delivery of the requested Open Source Code to you. This offer to obtain a copy of the Open Source Code is valid for three (3) years from the date you have licensed the Software.
OPEN SOURCE COMPONENTS. 9.1 The Buyer acknowledges that certain components of the Software may be OSS. To the extent required by the licenses covering such OSS components, the terms of their respective licenses will apply to the respective OSS components in lieu of the terms of this Agreement.

OPEN SOURCE COMPONENTS. The Software includes components that Saxonica uses, copies, modifies, and/or redistributes under the terms and conditions of various licenses. These components and their licenses may vary from one release of the Software to another. Some of these licenses may give You additional rights including for example the right to obtain and make modifications to the source code of the relevant component, subject to specific terms and conditions defined in the relevant license. Details of these components and the licenses that apply to them are included in the product documentation associated with each release of the Software, and the details that apply to the current release of the Software are published on the World Wide Web at xxxx://xxx.xxxxxxxx.xxx/documentation/index.html#!conditions or at such other location as Saxonica may determine.
OPEN SOURCE COMPONENTS. The PARTIES acknowledge that the SOFTWARE may contain open source components. For the avoidance of doubt, all utilization of open source components is governed by the applicable open source licenses.
