Notification of Unauthorized Use. You agree that as a condition of being approved to use Firstrade Securities Inc.'s Electronic Services you will immediately notify Firstrade Securities Inc. if:
Notification of Unauthorized Use. Licensee agrees to promptly notify Licensor of any unauthorized use of any of Licensed Marks as such unauthorized use comes to Licensee’s attention. Licensor shall have the sole right and discretion to take any action relating to Licensed Marks; provided, that Licensee agrees to cooperate fully, should Licensor decide to take any such action.
Notification of Unauthorized Use. Each party agrees to notify the -------------------------------- other party of any unauthorized use of the AOL Marks, Licensed Licensee Marks, AOL Domain Names, or New AOL Domain Names by third parties promptly as such use shall come to such notifying party's attention. Licensor shall initially have the sole right and discretion to bring proceedings alleging infringement of AOL Marks, AOL Domain Names, or New AOL Domain Names or unfair competition against such third parties ("Offensive Proceedings") and to defend proceedings brought or threatened against Licensor or Licensee based on use of AOL Marks, AOL Domain Names, or New AOL Domain Names. Licensee shall take such steps as Licensor and its Affiliates may reasonably request, at Licensee's expense, to assist Licensor in protecting Licensor's, AOL's and Licensee's rights in the AOL Marks, AOL Domain Names, or New AOL Domain Names. In the event that Licensor notifies Licensee in writing that Licensor elects not to prosecute an Offensive Proceeding, Licensee may request in writing that Licensor bring such proceeding, and upon such request, Licensor shall bring such proceeding, with all reasonable expenses incurred in connection therewith to be borne by Licensee.
Notification of Unauthorized Use. In the event the Licensee has notice of an unauthorized use of the Licensed Materials and cannot promptly remedy it, the Licensee shall immediately notify the Licensor. In the event the Licensor has notice of unauthorized use of the Licensed Materials, the Licensor will immediately notify Licensee, and Licensee will cooperate with the Licensor to address the unauthorized use and avoid a recurrence. Any unauthorized use that is considered a breach of obligations under this Agreement shall be subject to Section 6.4, below, including the cure period.
Notification of Unauthorized Use. If either party learns of (a) any -------------------------------- unauthorized use in the Territory of Licensed Products, Documentation, Third Party Products, or AOL Services Content, or (b) any AOL Services Content in the Territory that violates an applicable AOL Service Subscriber agreement or the rights of any Content provider or other Person, or is otherwise unauthorized Restricted Content, such party shall promptly inform the other party. In such an event, Licensee, at its own expense, shall take such steps as Licensor may reasonably request, to protect the rights of Licensor, Licensee, their Affiliates, and such Content providers and other Persons. Licensor, at its own expense, shall provide Licensee with commercially reasonable assistance in protecting such rights of such Persons.
Notification of Unauthorized Use. Nipro shall promptly notify -------------------------------- TheraSense in writing upon its discovery of any unauthorized use or infringement of the FreeStyle Products and/or TheraSense's patent, copyright, trademark or other intellectual property rights with respect thereto. TheraSense shall have the sole and exclusive right to bring an infringement action or proceeding against a third party, but TheraSense shall use its commercially reasonable judgment in determining its enforcement actions. In the event that TheraSense brings such an action or proceeding, Nipro shall provide commercially reasonable cooperation and provide commercially reasonable information and assistance to TheraSense and its counsel in connection with any such action or proceeding; provided that TheraSense shall reimburse Nipro for any direct costs (such as reasonable attorney's fees) incurred by Nipro.

Disetronic shall promptly notify -------------------------------- TheraSense in writing upon its discovery of any unauthorized use or infringement of the FreeStyle Products and/or TheraSense's patent, copyright, trademark or other intellectual property rights with respect thereto. TheraSense shall have the sole and exclusive right to bring an infringement action or proceeding against a third party, and, in the event that TheraSense brings such an action or proceeding, Disetronic shall cooperate and provide full information and assistance to TheraSense and its counsel in connection with any such action or proceeding; provided that TheraSense shall reimburse Disetronic for any expenses (including but not limited to reasonable attorney's fees) incurred by Disetronic.
Notification of Unauthorized Use. You will promptly notify us if you become aware of any unauthorized use of the Licensed Technology or violation or threatened violation of our Intellectual Property Rights therein. You agree to cooperate with us and render such assistance as we may reasonably request to identify, halt and/or prevent any violation of the provisions of this License.
