Noise Attenuation. 85. All diesel equipment shall be operated with closed engine doors and shall be equipped with factory-recommended mufflers.
Noise Attenuation. 8.1. The Owner agrees that all external air conditioners, ventilation systems, exhaust fans or other similar mechanical equipment shall be directed away from abutting properties and screened from view or otherwise located on the subject lands so as to attenuate noise impact on neighbouring residential properties, to the satisfaction of the Director of Community and Development Services.

All residential structures located within the 55dB CNEL or larger contours shall comply with Title 25 of the California Administrative Code to at- tenuate exterior noise such that interior noise levels shall not exceed 45dB CNEL in any habitable room. Enlargements and additions to a dwelling unit in existence on the effective date of these regulations shall only be subject to the noise attenuation standards of this Subsection for that portion of the structure that is to be enlarged or added to the existing structure.

(1) The Owner covenants and agrees to complete a noise study in accordance with the Region's "Noise Control Guidelines", for new developments, as may be amended, to determine the noise levels along Regional Road 125 (Xxxxxx Road) and the Canadian Pacific Rail line adjacent to the Plan of Subdivision and agrees that should the conditions on which the noise study is based change after acceptance of the noise study, and prior to the issuance of building permits, the Region may require the noise study to be updated, to the satisfaction of the Planning and Development Approvals Commissioner.

That the Developer shall have a qualified engineer investigate the need for acoustical shielding along Powerline Road and Rest Acres Road and the recommendations contained in the Noise Study be implemented through this Development Agreement. Should shielding be necessary, it shall be built to the satisfaction of the County, at the expense of the Developer. Any noise attenuation will be located on the lands being developed and not on municipal road allowances, and will be maintained by the Developer and subsequent owners. Each offer or purchase of all or any part of the Lands shall contain a caution to the purchaser that no alteration of the acoustical shield for the property or surrounding properties, and/or building or buildings, is permitted without the express written approval of the County. Also, maintenance and replacement of any acoustical shielding shall be at the sole cost and responsibility of the landowner. WATER SPRINGS
Noise Attenuation. The Contractor has not made any additional provisions for the treatment of noise within the Boiler House nor the location of the plate heat exchangers for each tower block as it was not envisaged at the time of tender.

Purchasers/Tenants are advised that despite the inclusion of noise control, features in this development area and within the dwelling units, noise levels from increasing traffic on the arterial roadways nearby may continue to be of concern, occasionally interfering with some activities of the dwelling occupants as the noise exposure level may exceed the noise criteria of the Ministry of the Environment. Purchasers/Tenants are advised that this dwelling unit has been fitted with a forced air heating system and ducting, etc., sized to accommodate central air conditioning (Air Conditioning Unit not included unless specified). Installation of Central Air Conditioning will allow windows and exterior doors to remain closed, thereby ensuring that the indoor sound levels are within the Ministry of the Environment noise criteria. Purchasers/Tenants are advised that the outdoor air-cooled condenser unit itself can produce noise that may interfere with outdoor recreational activities. Due consideration should be given to this noise factor when selecting the air cooled condenser unit location or an alternate quieter type of unit could be selected. The condenser unit sound rating should not exceed 7.6 BELS in accordance with ARI Standard 270-84 for units 3.5 tons or less. The location and the installation of the outdoor air conditioning device should be done so as to minimize the noise impacts and have due regard for compliance with criteria of MOE publication NPC-216, residential air conditioning devices. Purchaser/Tenants are advised and hereby put on notice that a sound barrier may be located inside the property line within the side and/or rear yard of this property and that the sound barrier shall not be altered or removed. It shall be the obligation of the owner of the lot to maintain and keep in repair that portion of the sound barrier situated on this property to the satisfaction of the Municipality.
