No Disabling Code. Provider shall not knowingly cause any disabling code to be incorporated into Products.

With respect to the Licensed Software (including any Updates or Upgrades) and as of the date of delivery, StataCorp represents and warrants that (i) it has used commercially reasonable efforts consistent with industry standards to scan for and remove any software viruses, and (ii) it has not inserted any Disabling Code. “Disabling Code” means computer code inserted by StataCorp that is not addressed in the Documentation and that is designed to delete, interfere with, or disable the normal operation of the Products. This Disabling Code warranty does not apply to StataCorp passwords necessary for the operation of the Licensed Software, to the Licensed Software’s Activation Key requirement, or for any use by Customer outside the scope of the license.

The Service Provider represents and warrants that the Services, and all systems, networks, devices or services that provide, monitor, access, or secure the Services including the SP Systems, will not contain any virus, Trojan horse, self- replicating or other computer instructions that may: (a) alter, destroy, inhibit or discontinue the Corporation’s effective receipt of the Services, BCLC IP or any Corporation Data, (b) erase, destroy, corrupt or modify any data, programs, materials or information used by the Corporation or its users, (c) store any data, programs, materials or information on the Corporation’s computers, including the computers of its users, (d) bypass any internal or external security measure to obtain access to the Corporation’s resources, or (e) introduce software, code, routine, program or similar material prohibited in the BCLC Services Manual.

No Disabling Code. The Software does not contain, and Vendor shall not insert into the Software any Disabling Code. Vendor shall use up-to-date, appropriate and commercially available virus scanning software (e.g., McAfee, Norton) and shall institute and follow reasonable virus scanning procedures. Vendor shall take commercially reasonable precautions so that Vendor does not transmit a Virus to any Insurint computing system.

During the Hosting Term, Vendor represents and warrants that prior to delivery of the American Well System to Elevance Health it has successfully tested the American Well System to determine if the American Well System contains threats known as software viruses, time or logic bombs, trojan horses, worms, trap doors or other functions, instructions, devices or techniques, whether implemented by electronic, mechanical or other means, that can or were designed to erase data or programming, infect, disrupt, damage, disable or shut down a computer system or any component of such computer system, including, but not limited to, its security or user data, or otherwise cause the American Well System to become inoperable or incapable of being used in accordance with the American Well Documentation.
No Disabling Code no software contained in the Products contains any software code that is intended to disable the software, such as computer viruses, back doors, time bombs, Trojan horses and the like, other than copy protection allowing Products to be remotely disabled by Viaduct II to prevent unauthorized use;
