Mutual Promises. The Company undertakes the obligations contained in the Employment Agreement, which are in addition to any compensation to which Employee might otherwise be entitled, in exchange for Employee’s promises and obligations contained herein. Mutual Promises. 2.1 No property interest created: Parent and Student acknowledge that because the Student is not a resident of LA XXXXX INDEPENDENT SCHOOL DISTRICT, any right of the Student to become or remain enrolled or to receive any educational services is based on this Agreement rather than on residence or on state eligibility criteria or any federal or state property interest. This Agreement does not create any property interest in favor of the student in becoming or remaining enrolled in any District school. This Agreement does not create any enforceable interest beyond its termination or revocation.

The Company undertakes the compensation and benefit obligations contained in Sections 7(b) and 9(a) of the Employment Agreement, which are in addition to any compensation to which Employee might otherwise be entitled, in exchange for Employee’s promises and obligations contained herein. The Company’s obligations are undertaken in lieu of any other compensation or employment benefits, and Employee acknowledges and agrees that, except as set forth in this Section 3, all of Employee’s outstanding and unvested restricted stock unit, performance unit and performance cash awards shall terminate as of the Retirement Date.

Mutual Promises. The Company undertakes the obligations contained in the Early Retirement Agreement in exchange for Employee's promises and obligations contained herein. The Company's obligations are undertaken in lieu of any other severance benefits, including, but not limited to, the benefits provided under the Severance Agreement executed by the parties on July 27, 1998.
Mutual Promises. (a) Landlord and Tenant, for themselves and their respective heirs, assignees, subrogees, successors and assigns, each hereby waive the right of recovery against the other, and the other's directors, officers, employees and business guests, and their respective heirs, administrators, executors, successors and assigns, for such loss or damage to the Premises and to any personal property situated thereon as is caused by fire or by those casualties which are described in the extended coverage provisions of the insurance contracts, as the case may be, or in the absence of such provisions in said contracts, by those casualties which commonly are described in the extended coverage provisions of insurance carried by the party, to the extent such loss or damage is covered by such party's insurance. Landlord and Tenant hereby agree that all insurance policies which each of them shall carry to insure the leased Premises and the contents therein against casualty loss, damage or theft, and all liability policies which each of them may carry pertaining to the use and occupancy of the leased Premises, shall contain waivers of the right of subrogation against the other and their respective heirs, administrators, successors and assigns, to the extent permitted by their insurance carriers.
Mutual Promises. In exchange for the promises which EMPLOYEE makes in this Agreement below, EMPLOYER agrees to provide to EMPLOYEE the additional benefits which are described below.
