2.2 In case the Allottee committing any delay or default in any payment tobe made to the Promoter hereunder, then without prejudice to the otherrightsandremediesofthePromoterinrespectofsuchdefaulthereunder or under law, the Promoter may appropriate the subsequentpayments made by the Allottee on such head/s of the defaulted amountand interest applicable thereon and in suchmanner as the Promotermay deem fit and proper and the Allottee shall not raise any objection,disputeorclaim in respect thereof.
MODEOFPAYMENT. Subject to the terms of this Agreement and Promoter/Developer abiding by the construction milestones, the Allottee/s shall make all payments, on a written demand by the Promoter/Developer, within the stipulated time as mentioned in the Payment Plan, described in Schedule-C through A/c Payee cheque/ demand draft or online payment (as applicable)in favour of “GAP INFRASTRUCTURE AND HOUSING PRIVATE LIMITED” payable at Kolkata. An intimation forwarded by the Promoter/Developer to the Allottee/s that a particular milestone of construction has been achieved shall be sufficient proof thereof. The issuance of such intimation by email or on any other digital platform at the address, email address or phone of the Allottee/s shall be sufficient intimation for the purpose of this clause by the Promoter upon the Allottee/s, and non-receipt thereof by the Allottee/s shall not be a plea or an excuse for non-payment of any amount or amounts.

MODEOFPAYMENT. SubjecttothetermsoftheAgreementandthePromoterabidingbytheconstruction milestones, the Allottee shall make all payments, on written demand by the Promoter, within the stipulated time as mentioned in the Payment Plan through A/c. Payee Cheques, Demand Drafts, Bankers' Cheque or online, as may be as applicable, in favour of the Promoter payable at the Bank as will be mentioned in the intimation of the Promoter for payments. In case any Cheque is dishonoured, besides the charges for late payment, the Allottee will also become liable to pay Rs.5000/- (Rupees Five Thousand only) for each such dishonour.
