Mechanical Royalties. (i) The Controlled Rate with respect to Controlled Compositions will be the rate equal to seventy five percent (75%) of the U.S. Minimum Statutory Rate at the time of the Delivery of the Master concerned (but in no event later than the last date for timely Delivery of such Master).
(ii) Notwithstanding anything to the contrary contained herein or in Annex “A” attached hereto, the total Mechanical Royalty for all Compositions (including Controlled Compositions) with respect to each Album (other than Multiple Record Albums) will be not more than ten (10) times the Controlled Rate.

In those instances when Symphonic receives what is considered the mechanical royalty as part of the fee from Partners, the portion deemed the mechanical payment shall be included in royalties paid to Client and Symphonic shall identify and specify in the relevant statement(s) what composition(s) and share of the royalties are an all-in payment which includes the mechanical royalty portion.

The Licensee is entitled to keep One Hundred (100%) of all royalties that are generated from record sales of the Master Recording on digital retailers (such as iTunes), through physical sales (such as Compact Disks), and on online streaming services (such as Spotify, Tidal, etc.)
