Maximum Cost. CONSULTANT expressly acknowledges that the total cost to complete all tasks set forth in “Exhibit A” must not exceed dollars ($ ) (“Maximum Cost”). When CONSULTANT has billed 75% of the Maximum Cost, CONSULTANT shall provide written notice to CITY’s Project Manager that CONSULTANT has expended 75% of the Maximum Cost.
Maximum Cost. The Maximum Cost to be paid to Supplier for Services will be the amount authorized in Purchase Orders authorizing the Services. Supplier will not perform Services in excess of the Maximum Cost specified in the Purchase Order unless authorized in advance by HP in a Change Order.
Maximum Cost. This is a cost reimbursable Contract with a maximum cost and contains a maximum fee and is subject to the conditions set forth in General Provisions 4 (GP4) article 14. Xxxxxx agrees to negotiate promptly and in good faith with Xxxxx for the purpose of definitizing this Contract for the Goods/Services set forth herein. The maximum cost and maximum fee is subject to negotiation and downward adjustment only. The maximum cost breakdown is as follows:
Maximum Cost. The cost to Seller of all alterations and upgrades set forth in Exhibit B plus all relocation costs incurred pursuant to Section 5.2 shall not exceed $500,000 ("Maximum Cost"). The Tenant Improvement Allowance in the amount of $500,000 shall be retained in escrow on the Closing Date until such time as Seller submits the bills or documentation of internal costs for the work set forth in Exhibit B. Seller shall submit to Escrow Agent proof of payment to third parties and documentation of internal costs for relocation and said alterations and upgrades as paid and incurred for reimbursement to Seller. Upon completion of the alterations and upgrades set forth in Exhibit B, Seller shall submit a Notice of Completion to Escrow Agent, and Escrow Agent shall deliver the balance of the Tenant Improvement Allowance funds in Escrow, if any, to Seller.
Maximum Cost. The Maximum Cost to be paid to Supplier for Services will be the amount authorized in Purchase Orders authorizing the Services. Supplier will not perform Services in excess of the Maximum Cost specified any Statement of Work and authorized by a Purchase Order. Confidential treatment has been requested for portions of this exhibit. The copy filed herewith omits the information subject to the confidentiality request. Omissions are designated as [****]. Maximum Cost. The total amount not to exceed under this Amendment shall be Two-Hundred Thousand Dollars ($200,000). The CONTRACTOR is not guaranteed that the CITY will purchase units up to the entire not to exceed amount.
Maximum Cost. After giving effect to such purchase, (i) the Acquisition Cost of the Assets shall not exceed the Fair Market Sales Value of such Assets as set forth in the Appraisal thereof delivered pursuant to clause (l), and (ii) the aggregate Asset Costs of all Assets subject to this Agreement shall not exceed the Maximum Cost.
Maximum Cost. After giving effect to the making of such Construction Advance, (i) the Asset Cost of the Assets shall not exceed the Fair Market Sales Value of such Assets as set forth in the Appraisal thereof delivered pursuant to Section 3.1(l), and (ii) the aggregate Asset Costs of all Assets subject to this Agreement shall not exceed the Maximum Cost.
Maximum Cost. Section 6.1 of the Agreement is amended to increase the annual not to exceed amount under this Agreement to One Million Five Hundred Thousand Dollars ($1,500,000) for additional substation projects.
