Limited Reliance. You acknowledge and agree that (i) our Services are not designed to be used for the operation of or within a High Risk System if the functioning of the High Risk System is dependent on the proper functioning of the Services and (ii) the outcome from any processing of data through the use of the Services is beyond our control. You are responsible for the use and interpretation of the outcome from such processing and any reliance on such outcome.
Limited Reliance. EBI has relied solely on the information contained in this Agreement and its own investigation of the Company in making a decision to acquire the Shares. EBI has not relied on any representations or warranties made by anyone apart from those set forth in this Agreement.
Limited Reliance. Subscriber acknowledges and agrees that the outcome from any processing of data through the use of the Services is beyond our control. Subscriber is responsible for the use and the interpretation of the outcome from such processing and any reliance on such outcome.

Investor has not relied on any representations or warranties made by anyone apart from those set forth in this Agreement and in the Disclosure Documents.

Customer acknowledges and agrees that (i) PlantSight Services and Software are not designed to be used for the operation of or within a High Risk System if the functioning of the High Risk System is dependent on the proper functioning of the PlantSight Services and Software and (ii) the outcome from any processing of data through the use of the PlantSight Services and Software is beyond SISW’s control. Customer is responsible for the use and interpretation of the outcome from such processing and any reliance on such outcome. Customer will indemnify SISW, its Affiliates and Providers, and each of their respective employees, officers, directors, and representatives from and against, and, at SISW’s option defend SISW against, any claims, damages, liabilities, losses, costs, or expenses (including reasonable attorney’s fees) arising from or in connection with use of PlantSight Services or Software for the operation of or within a High Risk System, if the functioning of a High Risk System depends on the proper functioning of a PlantSight Service or Software or a PlantSight Service or Software caused a High Risk System to fail.

Customer acknowledges and agrees that (i) PlantSight Services are not designed to be used for the operation of or within a High Risk System if the functioning of the High Risk System is dependent on the proper functioning of the PlantSight Services and (ii) the outcome from any processing of data through the use of the PlantSight Services is beyond SISW’s control. Customer is responsible for the use and interpretation of the outcome from such processing and any reliance on such outcome. Customer will indemnify SISW, its Affiliates and Providers, and each of their respective employees, officers, directors, and representatives from and against, and, at SISW’s option defend SISW against, any claims, damages, liabilities, losses, costs, or expenses (including reasonable attorney’s fees) arising from or in connection with use of PlantSight Services for the operation of or within a High Risk System, if the functioning of a High Risk System depends on the proper functioning of a PlantSight Service or a PlantSight Service caused a High Risk System to fail.
Limited Reliance. The case evaluation produced by CCM may be used or relied only by Client and solely for the Captioned Case being evaluated. Further, such case evaluations speak only as of the date on which it is issued. The Case Evaluator has no obligation to update the case evaluation for applicability to Client or to take into account changes in the law or changes in the facts or any other developments that may occur after the case evaluation issue date.
Limited Reliance. MegaWorld represents, warrants, acknowledges, and confirms that, except for representations and warranties of TBS and CDMP expressly contained herein or in the TBS Disclosure Schedule, MegaWorld has relied on no representations or warranties by either of TBS or CDMP, whether oral or written, express or implied, in any decision related to this Agreement, including without limitation the execution of this Agreement. Further, MegaWorld represents, warrants, acknowledges, and confirms that certain Directors of MegaWorld have been privy to certain confidential information regarding certain technology and associated product(s) ("Blast Guard Technology" herein) sometimes referred to as "Blast Guard," whose patent rights are owned by JoyVer, Inc., an entity owned and controlled by CDMP. While acknowledging this disclosure, it is acknowledged by all parties hereto that CDMP has made presentations to MegaWorld proposing MegaWorld's funding of a separate entity to exploit the Blast Guard Technology. However, this proposal was declined and not funded by MegaWorld, and all parties hereto agree that the Blast Guard Technology does not comprise any part of the consideration for this Merger; and MegaWorld, on behalf of itself, its subsidiaries, divisions, and affiliates, expressly acknowledges (i) that the Blast Guard Technology is not in any way a part of the transactions contemplated herein, (ii) that TBS owns no rights of any nature in the Blast Guard Technology, and (iii) that any such arrangement concerning the Blast Guard Technology would be the subject of a completely separate and distinct agreement, to be negotiated, by and between JoyVer, Inc. and MegaWorld.
Limited Reliance. Purchaser has relied on no representations or warranties of Seller other than those expressly set forth in this Agreement.

Customer acknowledges and agrees that (i) APS Services and Software are not designed to be used for the operation of or within a High Risk System if the functioning of the High Risk System is dependent on the proper functioning of the APS Services and Software and (ii) the outcome from any processing of data through the use of the APS Services and Software is beyond SISW’s control. Customer is responsible for the use and interpretation of the outcome from such processing and any reliance on such outcome. Customer will indemnify SISW, its Affiliates and Providers, and each of their respective employees, officers, directors, and representatives from and against, and, at SISW’s option defend SISW against, any claims, damages, liabilities, losses, costs, or expenses (including reasonable attorney’s fees) arising from or in connection with use of APS Services or Software for the operation of or within a High Risk System, if the functioning of a High Risk System depends on the proper functioning of a APS Service or Software or a APS Service or Software caused a High Risk System to fail.
