Liability of Trustee Clause Samples
The 'Liability of Trustee' clause defines the extent to which a trustee can be held responsible for actions taken in their role managing a trust. Typically, this clause limits the trustee's liability to instances of gross negligence, willful misconduct, or breach of trust, protecting them from personal liability for honest mistakes or actions taken in good faith. For example, if a trustee makes an investment decision that results in a loss but acted prudently and in accordance with the trust's terms, they would generally not be personally liable. The core function of this clause is to encourage individuals to serve as trustees by providing them with reasonable protection from personal financial risk, while still holding them accountable for serious wrongdoing.
