Level Playing Field. (a) The Seller shall cause the Seller Distributors not to provide to the Sales Force or the DAS any compensation or other economic inducement or benefit for the sale of comparable products sold in a comparable sales support and compensation framework offered by a Third Party Insurer that is more favorable than the compensation or other economic inducement or benefit provided to such Sales Force for the sale of such products offered by a Buyer Insurer.

Balancing responsibilities It appears to be a common understanding that full balancing responsibility for all market participants is an important prerequisite for a well-functioning electricity and thus balancing market, with equal access for all players and a level playing field for all market players. There is wide agreement that the Balance Responsible Parties (BRPs) play an essential role, and that balancing responsibility for all market participants is an important condition for system balancing, for security of supply and efficient market functioning. The Electricity Balancing Guideline5 aim to standardize and harmonize to a large extent the national terms and conditions for balancing services providers (BSPs) and balance responsible parties (BRPs). It that context, responsibilities for all market players are foreseen. Balancing responsibilities for all parties should, however, be accompanied by the existence of markets that allow trading close to real time (specially Intraday market with short gate closure times and with a sufficient level of liquidity) to minimize forecast errors and markets that have fair access rules to balancing markets for all market parties (see section 3.4 for further analysis). Priority dispatch Regulatory frameworks will increasingly expose renewables generators to market risks. Today some EU markets which have relatively high penetration rates of renewables, do not offer priority dispatch for renewables producers and this does not place any restrictions on market growth. Besides, these markets offer market-based instruments to allow them to participate in balancing markets and to voluntarily dispatch-down their output. In general, priority dispatch for any technology should be set according to market maturity and liberalisation levels in the Member State concerned, but it should also take due account of progress in grid developments and should apply the best practices in system operation. Level Playing Field. 12.2.1 The Franchise Authority agrees that any grant of additional franchises or other authorizations by the Grantor to any other entity to provide video or other services similar to those provided by Grantee pursuant to this Franchise and over which the Grantor has regulatory authority shall require that service be provided on substantively similar terms and conditions to those which are set forth herein.
Level Playing Field. (a) This Renewal License shall not affect the right of the Issuing Authority to grant to any other person a license or right to occupy or use the streets, or portions thereof, for the construction, upgrade, installation, operation or maintenance of a Cable Communications System within the Town of Lancaster; or the right of the Issuing Authority to permit the use of the public ways and places of the Town for any purpose whatsoever. The Licensee hereby acknowledges the Issuing Authority's right to make such grants and permit such uses.
Level Playing Field. The LPF provisions are essential to ensure fair competition, as both parties have agreed on a tariff- free and quota-free trade. The initial provisions of this chapter reiterate the necessity that “trade and investment take place in a manner conducive to sustainable development”. Harmonisation of standards is not the objective of the TCA but “the Parties are determined to maintain and improve their respective high standards in the areas covered by [the LPF] Title”, which include environment and climate. The parties also reaffirm their ambitions to reach climate neutrality by 2050, and their acceptance of the precautionary approach allowing the Parties, “where there are reasonable grounds for concern that there are potential threats of serious or irreversible damage to the environment or human health”, to adopt measures even if full scientific certainty is lacking. This language is better than what the EU has included in the EU-Mercosur agreement, especially as the provision does not impose the revision of the measure as soon as possible. The section on environment and climate includes in its scope “the management of impacts on the environment from agricultural or food production, notably through the use of antibiotics and decontaminants.” That could, to a certain extent, allow for discussion of intensive animal agriculture, as it is a source of significant pollution, but not directly animal welfare. The Parties commit to “strive to increase their respective environmental and climate protection levels” and to promote environment-friendly practices. However, within the list of such practices, there is no mention of any in relation to agriculture (while there were in EU proposals). The provisions on wildlife trafficking are similar to the ones contained in the EU-Mexico agreement, and the ones on the promotion of sustainable aquaculture and fisheries do not mention fish welfare, nor refer to OIE standards. The specific DSM attached to this chapter is similar to the one linked to Trade and Sustainable Development (TSD) chapters in other EU FTAs: in case of a dispute, the Parties can request the setting up of a panel that will produce a report on the matter. If the Party found in violation of the TCA by the Panel does not want to take any measure, there are no further procedures available. Level Playing Field. (a) The Grantor shall comply with Government Code Section 53066.3. It is the Grantor’s intent to grant franchises to another individual or entity to provide Cable Services on material terms and conditions that are not more favorable or less burdensome than the terms and conditions applicable to Grantee and do not place Grantee at a competitive disadvantage. If any such additional or competitive franchise is granted by the Grantor which contain substantially more favorable or less burdensome terms or conditions than this Franchise, the Grantor agrees that it shall amend this franchise to include any more favorable or less burdensome terms or conditions in a manner mutually agreed upon by the Grantor and Grantee.
