Leasehold Mortgagee Sample Clauses

Leasehold Mortgagee. Any unaffiliated third party public or private lending source or institution, federal, state, county or municipal governmental agency or bureau, bank, savings and loan, pension fund, insurance company, real estate investment trust, tax credit syndication entity, or other real estate investment or lending entity, savings bank, whether local, national or international, and/or the holder of any purchase money mortgage given back to a transferor, that is or becomes the holder, mortgagee or beneficiary under any Leasehold Mortgage and the successors or assigns of such holder, mortgagee or beneficiary, and shall be deemed to include, without limitation, the trustee under any such trust indenture and the successors or assigns of such trust; provided that if a Leasehold Mortgagee is other than a federal, state, county or municipal governmental agency or bureau, or a United States-based bank, savings and loan, pension fund, insurance company, or real estate investment trust, then except as may otherwise be prohibited by applicable Laws, a Leasehold Mortgagee shall not be a Disqualified Person, as hereinafter defined.

Leasehold Mortgagee. “Leasehold Mortgagee” shall have the meaning set forth in Section 20.2 below.
Leasehold Mortgagee. Lessor agrees that the name of any Leasehold Mortgagee, as hereinafter defined, may be added to the loss payable endorsement of any and all insurance policies required to be carried by Lessee hereunder (except for Worker’s Compensation).
Leasehold Mortgagee. The term "Leasehold Mortgagee" ------------------- as used in this Section 4 shall refer to a holder of a Leasehold Mortgage in respect to which the notice provided for by subsection 4.2 has been given and received and as to which the provisions of this Section 4 are applicable.

Tennnt acknowledges on its and Leasehold Mortgagee's behalf that Landlord has not reviewed and is not a party to any loan documents between Tenant and the Leasehold Mortgagee and is not obligated to Leasehold Mortgagee for any obligations of Tenant to the Leasehold Mortgage.
Leasehold Mortgagee. Lessee is hereby given the right by Lessor, subject to approval by the Lessor, to mortgage its interest in this Agreement and assign its interest in this Agreement as collateral security for such mortgage upon the condition that all rights acquired under such mortgage shall be subject to each and all of the covenants, conditions and restrictions set forth in this Agreement, and to all rights and interests of Lessor herein, none of which covenants, conditions or restrictions is or shall be waived by Lessor by reason of the rights given Lessee to mortgage its interest in this Agreement, except as expressly provided in this Section 29 and upon the further condition that the mortgagee or beneficiary of such mortgage or assignment shall be an institution. For purposes of this Section 29, an “Institution” shall mean a bank, savings and loan association, trust company, insurance company, public pension fund or retirement fund, or a special purpose entity formed to originate or hold commercial mortgages in connection with a securitization transaction. If Lessee shall mortgage all or part of its interest in this Agreement and if the holder of such mortgage shall, within thirty (30) days of its execution, send to Lessor a true copy thereof together with written notice specifying the name and address of the mortgagee and the pertinent recording data with respect to such mortgage, Lessor agrees that so long as the leasehold mortgage remains unsatisfied of record or until written notice of satisfaction is given by the holder to Lessor, the following provisions shall apply:

Leasehold Mortgagee. The holder of a Leasehold Mortgage.
Leasehold Mortgagee. If a First Leasehold Mortgage and a Permitted Leasehold Mortgage that is second in priority in lien or interest among those in effect are both held by the same Permitted Leasehold Mortgagee, the two Permitted Leasehold Mortgages are collectively referred to as the "First Leasehold Mortgage." A "Permitted Leasehold Mortgage" includes, without limitation, mortgages and trust deeds as well as financing statements, security agreements, and other documentation that the lender may require. The words Lending Institution, as used in this Lease, mean any commercial, national, or savings bank, savings and loan association, trust company, pension trust, foundation, or insurance company, and any other entity, person, corporation, partnership, or otherwise making a loan on the security of Lessee's interest in this Lease or all or any part of the Improvements.
