Lease Property. Based on results of qualifying the Tenant, Altisource will accept or deny Tenant’s application for housing, consistent with local, state and federal regulations; provide appropriate lease documents and addenda; negotiate on behalf of Residential as to required rent amount, acceptance of pets or any other conditions as may exist; execute the lease with Tenant; and collect security deposit and first month’s rent. Altisource will also negotiate with Tenant to renew Tenant’s lease for an additional term.
Lease Property. (a) As of the Closing Date, Schedule 5.21(a) is a correct and complete list of each Lease Property of the Company and its Subsidiaries.
(b) As of the Closing Date, Schedule 5.21(b) is a correct and complete list of each Unencumbered Lease Property with respect to any Credit Party.
(c) Each of the properties included by the Company in the calculation of Aggregate Total Fixed Asset Value satisfies all of the requirements contained in the definition of Lease Property. Each of the properties included by the Company in the calculation of Aggregate Unencumbered Fixed Asset Value satisfies all of the requirements contained in the definition of Unencumbered Lease Property.
Lease Property. 1.1 The Landlord is the owner of the property located at ▇▇▇▇▇▇▇▇▇▇▇▇▇▇▇▇ ▇, ▇▇▇▇▇ Planegg, which is also referred to below as the “Property.”
1.2 The Landlord leases to the Tenant the Property including the building on the Property and the following areas (“Lease Areas”) and car parking spaces (Property, Lease Areas and car parking spaces together also referred to as “Lease Property”), whose locations are detailed on the Site Map and Lease Area plans attached as Appendix 1:
(a) Office space (including, entryways, staircase, etc.) approx. 10,395 m²
(b) Laboratory areas (S2 standard) approx. 2,200 m²
(c) Archive space (basement) approx. 1,523 m²
(d) Car parking spaces (underground) 271 spaces
(e) Car parking spaces (outside) 12 spaces
1.3 The size of the Lease Property shall be determined after the completion of its conversion in accordance with the area definition attached as Appendix 2 (in accordance with the Directive for the Calculation of Commercial Lease Space of the Association for Real Estate Research) using planimetric CAD measurement from the implementation plans. The staircases and intermediate platforms located within the Lease Property are also part of the Lease Area. The parties undertake to document the result of the measurement – assuming objective accuracy – in a supplement to the Lease Agreement in conformity with the written form clause. Any deviations in the size of the Lease Areas described in Paragraph 1.2 from the actual proportions of the Lease Property that amount up to 3% of the Lease Areas described in Paragraph 1.2 shall not give rise to either a claim by the Landlord or the Tenant for an adjustment in the cost of the net base lease amount or in the prepayment of ancillary costs. In the event of a difference of more than 3%, the net base lease amount and the prepayment of ancillary costs will be adjusted for the full difference at the request of either party. In this case, the parties will record the actual proportions of the Lease Area that were determined as well as the resulting adjustment in the net base lease amount and the advance payment of ancillary costs as part of a proper amendment to the Lease Agreement. Neither the Landlord nor the Tenant may request such an adjustment one year after the Lease Property has been transferred.
1.4 The Landlord undertakes to convert and equip the Lease Property in accordance with the following documents and principles (in the case of contradictions, priority is given to the preceding app...
Lease Property. (a) As of the Closing Date, Schedule 4.21(a) is a correct and complete list of each Lease Property of the Borrower and its Subsidiaries.
(b) As of the Closing Date, Schedule 4.21(b) is a correct and complete list of each Unencumbered Lease Property with respect to any Loan Party.
(c) Each of the properties included by the Borrower in the calculation of Aggregate Total Fixed Asset Value satisfies all of the requirements contained in the definition of Lease Property. Each of the properties included by the Borrower in the calculation of Aggregate Unencumbered Fixed Asset Value satisfies all of the requirements contained in the definition of Unencumbered Lease Property.
Lease Property. 2.1 The lease items under this Contract refer to the items mentioned in the List of Lease Items (Appendix III, same hereinafter). Signed between the lease item and the lessor and the lessee the lease item purchase contract (after-sales leaseback) (attachment 1, similarly hereinafter) the appointment of buy and sell the subject matter.
2.2 The leased Property is purchased by the lessor from the lessee according to the lessee’s requirements and independent choice. The lessee does not rely on the lessor’s skills to determine the leased property and the seller, and the lessor does not interfere with the lessee’s choice of the leased property and the seller.
2.3 Both parties agree that the residual value of the leased property under this Contract at the end of the lease term (hereinafter referred to as the “residual Value of the Leased Property”) shall be 5% of the purchase price of the leased property paid by the Lessor. If otherwise agreed in the Schedule of Contracts (Appendix II, the same below), such agreement shall prevail. And both parties agree that such amount shall be used as the basis for dealing with matters related to the residual value of the leased property under the Contract.
2.4 The depreciation amount of the leased property under this Contract shall be calculated from the lease date, based on 95% of the purchase price of the leased property paid by the lessor, using the straight-line method. The depreciation period shall be the lease term stipulated in the Contract Schedule, and the depreciation amount shall be calculated on a daily basis. Both parties agree that the above method shall be used as the basis for calculating the value, depreciation and other relevant matters of the leased property hereunder.
2.5 If the Contract is deemed invalid by the People’s Court, the leased property shall be owned by the Lessor, and the Lessee shall return the leased property to the Lessor or make payment to the Lessor in the form of discount compensation, and the Lessor shall have the priority to request the Lessee to make discount compensation for the leased property. The total amount of the discount compensation shall be the sum of all the unpaid rent, other payments payable by the lessee and the residual value of the leased property.

Lease Property. 1. In accordance with Article 71, paragraph (1) of the PFI Act and this Agreement, the State shall grant to the Operating Right Holder, at no charge, the right to use the lease properties listed in Attachment 1.
2. At the time of conclusion of this Agreement, the lands included in the lease properties set forth in Attachment 1 shall be specified by information recorded in the National Property Registry. This Agreement shall automatically terminate if, after execution of this Agreement, the State changes the public notice with respect to the Airport Site as a result of a review of the Airport Site of the Airport or a fixing of the boundaries and the lands cease to be the subject of such public notice.
Lease Property. Since Party B’s new factory construction still requires time and cannot be completed as scheduled, Party A agrees to lease its land, factory, and equipment to Party B for temporary production.

(b) As of the First Amendment Effective Date, Schedule 4.21(b) is a correct and complete list of each Unencumbered Lease Property with respect to any Loan Party.
(c) Each of the properties included by the Borrower in the calculation of Aggregate Total Fixed Asset Value satisfies all of the requirements contained in the definition of Lease Property. Each of the properties included by the Borrower in the calculation of Aggregate Unencumbered Fixed Asset Value satisfies all of the requirements contained in the definition of Unencumbered Lease Property.
