Inactive Account. The Client's Payment Account is considered inactive when, after a period of twelve (12) months, it has not been the subject of any transaction (excluding management fees) on the initiative of the Client (or any User) and that the latter has not made any representations to Paynovate in any form whatsoever. When the Account is considered inactive, Paynovate informs the Client by any means. In the absence of a response from the Client or any new transaction on the Account and in the case where the balance is positive, the Account will be closed at the end of a period of ten (10) years from the last transaction on the account. The Client will be informed by any means six (6) months before the effective closing of the Account. The balance will be deposited with the authorized Institution and the sums may be claimed by the Client or his beneficiaries for twenty (20) years from their deposit. Paynovate may debit an inactive account management fee each year, to the extent permitted by law.

Inactive Account. If you have not placed a trade, opened or closed positions or made a deposit into the Account(s) over a consecutive period of ninety (90) days or more and you are not actively paying monthly and/or quarterly commissions or fees for Market Data, you acknowledge and agree that: (a) we may (at our sole discretion but we are not obliged to) classify your account as inactive or dormant (“Inactive Account”); (b) unless prohibited by Applicable Regulations, we may charge a monthly service fee of USD 25, or currency equivalent, whilst the Account remains inactive, for maintenance, administration, and compliance management of such Inactive Account (“Inactivity Fee”); (c) the Inactivity Fee will be charged separately for each Inactive Account. However, where you have more than one (1) Account, and at least one of your Accounts is active, no Inactivity Fee will apply; (d) where the balance of any Inactive Account to which Inactivity Fee is applicable is less than the Inactivity Fee, then the Inactivity Fee for such Inactive Account will be equal to the amount of the remaining balance on such Inactive Account; (e) we reserve the right to charge the Inactivity Fee retroactively for any month in which we had the right to charge it but did not do so; (f) it is at all times your responsibility to monitor the status of your Account and we will not be obligated to inform you of the change of the status of your Account or to send you any notification prior to any charge of the Inactivity Fee; (g) any Inactive Account, holding zero (0) balance, may be (at our sole discretion but we are not obligated to) turned to dormant ("Dormant Account"); (h) for re-activation of a Dormant Account, you must contact us and inform us of your wish to reactivate the Dormant Account; and (i) we reserve the right to request that you submit all relevant information and supported documentation that we deem necesary to process your re-activation request and that we reserve the right to terminate this Agreement if you fail to submit such information and supported documentation in the provided timeframe.
Inactive Account. A Payment Account is deemed inactive if: • the Payment Account has not processed any payment Transactions, excluding deductions made by LEMON WAY for fees and commissions of all kinds, for twelve (12) months, during which • the Account Holder, legal representative or person authorised by them to act on their behalf has not presented themselves to LEMON WAY, in any way, shape or form, or • within the twelve (12) months following Account Holder's death.
