The Impervious Cover clause defines and regulates the portion of a property that may be covered by surfaces that do not allow water to penetrate, such as concrete, asphalt, or buildings. It typically sets a maximum percentage of the total lot area that can be covered by these materials, ensuring that a certain amount of land remains permeable for water absorption. This clause is essential for managing stormwater runoff, reducing the risk of flooding, and promoting environmental sustainability in property development.
Impervious Cover. Developer may develop the Project with an Impervious Cover Percentage that does not exceed thirty-five percent (35%) over the entire Project. Developer shall have the right to apportion impervious cover limits on a lot by lot or use by use basis not to exceed the applicable maximum impervious cover percentage shown in Exhibit I on each residential lot, and for the commercial portion of the Project as set forth in Section 3.1.4. 1. Developer may apportion such limits as it deems desirable so long as the overall limitation herein specified is not exceeded.
