HITECH. “HITECH” or the “HITECH Act” means Subtitle D of Title XIII of the American Recovery and Reinvestment Act of 2009, known as The Health Information Technology for Economic and Clinical Health Act, including its implementing regulations.
HITECH. “HITECH” is defined in Section 3.13(h) of the Agreement.
HITECH. In the event of any inconsistency or conflict between Part II and Part III, the more stringent provision shall apply. Applicability of HITECH and HIPAA Privacy Rule and Security Rule Provisions Title XIII of the American Recovery and Reinvestment Act of 2009 (ARRA), also known as the Health Information Technology Economic and Clinical Health (HITECH) Act, requires a Business Associate that contracts with the Agency, a HIPAA covered entity, to comply with the provisions of the HIPAA Privacy and Security Rules (45 CFR 160 and 164).
HITECH. Business Associate acknowledges and understands that HITECH (including the rules and regulations promulgated thereunder) imposes direct responsibility on Business Associate for its conduct as a business associate and that Business Associate is subject to direct liability for both civil and criminal penalties for its violations of the Regulations and may be subject to direct liability for both civil and criminal penalties for the violations of its Subcontractors. Any limitation of liability in the Underlying Agreement shall not apply to damages hereunder. Each party agrees to indemnify and hold harmless the other party and the other party’s directors, officers, agents and employees, from and against any and all penalties, claims, actions, liability, loss, damages or expense (including court costs and reasonable attorneys’ fees) arising out of the indemnifying party’s act or failure to act resulting in damages relating to the unauthorized access to, or the disclosure, loss, destruction or use of PHI, or other violation of this Agreement.

HITECH. “HITECH” shall mean the Health Information Technology for Economic and Clinical Health Act.
HITECH. “HITECH” shall mean the Health Information Technology for Economic and Clinical Health Act (enacted as part of the American Recovery and Reinvestment Act of 2009), including Sections 164.308, 164.310, 164.312, and 164.316 of Title 45 of the Code of Federal Regulations.
HITECH. “HITECH” shall mean the Health Information Technology for Economic and Clinical Health Act, which is at Section 13400, et. seq. of ARRA, 42 U.S.C. §§ 17921, et. seq., and guidance promulgated thereunder.
HITECH. Each party will comply with each obligation applicable to such party under HITECH as of the date that compliance with such obligation is required under the same. In furtherance thereof:
HITECH. A. Business Associate acknowledges that HITECH requires Business Associate to adhere to the administrative, physical, and technical safeguards, and policy, procedure, and documentation requirements of the HIPAA Administrative Simplification Security Rule in the same manner that such sections apply to Covered Entity, and Business Associate shall so comply.
