Hire Period. 24.1 Where a timing device is mounted on the Equipment it may be used by Proquip to determine the time the Equipment was in use by the Client unless otherwise stated in the Hire Schedule. Where the meter is found not to be working either during or at the Termination Date then Proquip will estimate the hours used and the onus is on the Client to prove otherwise.
24.2 Hire charges shall commence from the time the Equipment is collected by the Client from Proquip’s premises and will continue until the return of the Equipment to Proquip’s premises, and/or until the expiry of the Minimum Hire Period, whichever last occurs.
24.3 Unless otherwise agreed by Proquip, the Minimum Hire Period shall be for a period of one (1) day and usage shall not exceed eight (8) hours within that period.
24.4 The maximum allowable daily use shall not exceed eight (8) hours within any twenty four (24) on-hire period. Excess use charges will be applied in accordance with clause 24.1.
24.5 If Proquip agrees with the Client to deliver and/or collect the Equipment, hire charges shall commence from the time the Equipment leaves Proquip’s premises and continue until the Client notifies Proquip that the Equipment is available for collection, and/or until the expiry of the Minimum Hire Period, whichever last occurs.
24.6 Equipment must be returned or made available for collection by 9am on the designated off-hire day or additional charges will apply.
24.7 No allowance whatsoever can be made for time during which the Equipment is not in use for any reason, unless Proquip confirms special prior arrangements in writing. In the event of Equipment breakdown provided the Client notifies Proquip immediately, hiring charges will not be payable during the time the Equipment is not working, unless the condition is due to negligence or misuse on the part of or attributable to the Client.
Hire Period. For day trips on the Shropshire Lady, start and finish times will be confirmed with the Trust’s Skipper depending on the Hirer’s request. Start and finish times must be between 10am to 6pm.
Hire Period. 5.1 Where hire of the Hire Goods is to a Customer who is an individual (whether a consumer or otherwise) or relevant recipient of credit as defined under Article 60L of the Financial Services and Markets Act 2000 (Regulated Activities) Order 2001 e.g. (a). a partnership consisting of two or three persons not all of whom are bodies corporate, or (b) an unincorporated body of persons which does not consist entirely of bodies corporate and is not a partnership(‘Relevant Individual’), the Hire Period shall commence on the date [specified out in writing by the Supplier] (‘Hire Start Date’) and shall end on the earlier of (i) [the date specified in the Commercial Terms Schedule]; or (ii) the last day of the 3 month period commencing on the Hire Start Date (‘Option 1 Hire End Date’). For the avoidance of doubt, as the Hire Period to Relevant Individuals is no longer than 3 months, the hire of any Hire Goods is not covered by the Consumer Credit Act 1974.
5.2 Where the Customer is not a Relevant Individual, the Hire Period shall commence on the Hire Start Date and shall end on the date specified in the Commercial Terms Schedule (‘Option 2 Hire End Date’).
5.3 On the Option 1 Hire End Date or the Option 2 Hire End Date (as applicable), the Customer shall: (i) physically return the Hire Goods into the Supplier’s possession; or (ii) make the Hire Goods available for physical repossession or collection by the Supplier [in a location specified by the Supplier], as applicable.
5.4 For the avoidance of doubt, the Hire Period shall automatically end on the Option 1 Hire End Date or the Option 2 Hire End Date, as applicable and the Customer shall not be required to pay the Rental in respect of any period in which the Hire Goods are in the Customer’s possession or control outside the Hire Period.
5.5 Notwithstanding clause 5.4, If the Customer fails to comply with its obligations in this clause 5, then it shall be liable for any financial loss which this causes the Supplier [and shall indemnify the Supplier in full and on demand in respect of any costs, liabilities, losses and expenses (including legal fees) incurred as a result].
Hire Period. The period of hire for an item of Hire Equipment (Hire Period):
(a) runs from the time at which the Hire Equipment leaves the Collection Depot (regardless of whether it is collected by the Customer or TEN organises shipping or transport); and
(b) ends when the Hire Equipment is returned by the Customer to TEN in accordance with clause 7.2(d) (regardless of whether it is collected by TEN or the Customer organises shipping or transport).
Hire Period. For weekly bookings the hire period is 6 nights use of the holiday boat. The holiday boat will be available from 3pm on the Saturday commencing the hire period and must be returned to Lyneal Wharf by 3pm on the Friday ending the hire period. Breach of this condition will incur a minimum additional charge of £50 per hour or part thereof. In addition, the Hirer will be liable for any extra costs and/or damages incurred by the Trust as a result of the boat not being available on time for the next hirer. Where the Trust has to recover a boat, and return it to Lyneal Wharf, the Hirer shall be liable for all costs involved. For short break bookings start and finish times can vary dependent on the days requested.
Hire Period. 8.1. All Hire Charges are for a minimum of seven (7) days of Hire, and thereafter Hire is calculated daily at the weekly Hire rate divided by seven (7) days.
8.2. Hire Charges shall commence when the Equipment is erected or from when the Equipment has started to be used and shall continue until you advise us that the Equipment is ready for removal from the Worksite. If you revoke the Off-Hire Notice or have continued to use the Equipment after the Off-Hire period has occurred, then the Hire Charges shall continue without interruption until the end of the Hire Period or until the expiry of the Minimum Hire Period (whichever occurs last).
8.3. It is agreed by both parties that:
(a) any return of Equipment to our premises must be completed during our regular business hours and while our staff are present;
(b) in the event the Equipment is not returned to us by the end of the specified Hire period, you will be charged at our current daily rate until the Equipment is returned; and
(c) you must not submit the Equipment for return if it has not been cleaned (including the removal of all asbestos fibres or other hazardous substances such as mortar, render, epoxy, or other applied finish debris).
8.4. No allowance can be made for time during which the Equipment is not used for any reason unless we confirm special prior arrangements in writing. In the event of any Equipment malfunction (provided you notify us immediately), Hire Charges will not be payable during the time the Equipment is not working (unless the malfunction is due to negligence or misuse on your part or is attributable to your actions).
8.5. We retain the right at all times during the Hire Period to inspect the Equipment.
8.6. Where you request us to inspect the Equipment other than the initial or weekly inspection, you acknowledge and agree that all associated costs for such Services shall be charged additionally as a variation (in accordance with clause 7).
8.7. None of the Equipment shall be sublet or cross-hired by you, and you agree to not assign or transfer your interest in this Agreement, or part with possession of all, or any component of the Equipment, without our prior written consent (which may be withheld at our sole discretion).
8.8. Should the Hire of the Equipment exceed a twelve (12) month Hire Period (or a six (6) month Hire Period with the right of renewal), clause 21 shall apply and will constitute a Security Agreement in the form of a lease for a term of more than one (1) year (as...
Hire Period. The Agreement starts on the date stated in the Agreement (the “Start Date”) and will continue until terminated as provided herein. The total period of hire is referred to as the “Hire Period”. The minimum hire period is 28 days (4 weeks).
