Export Prohibition. The export and re-export of the Software is controlled by the United States Export Administration Regulations, and such Software may not be exported to Cuba, Iran, Iraq, Libya, North Korea, Sudan, or Syria, or any other country to which the United States embargoes goods. In addition, the Software may not be distributed to persons on the Table of Denial Orders, the Entity List, or the List of Specially Designated Nationals. By downloading or using the Software, you acknowledge that the Software and documentation, and the products they are used in conjunction with, are subject to U.S. and other countries' export and import laws and regulation, and agree to comply strictly with all such laws and regulations. You certify that you will NOT transfer or export, directly or indirectly, any software or documentation, or any portions thereof, including without limitation any technical data, related materials, or updates, into any country or to any entity prohibited under the above-referenced Export Regulations, as amended, or in violation of any other applicable law, nor use them in any manner or for any purpose prohibited by such regulations or in violation of any other applicable law.

Export Prohibition. The Purchaser acknowledges that its exportation of the products or any parts thereof sold hereunder may be subject to compliance with various export laws, rules and regulations which restrict the export of certain products and technical data. Accordingly, the Purchaser warrants and represents that it will not export the products or any parts thereof sold hereunder outside the United States, either directly or indirectly, and shall not disclose technical data in any form to a foreign person (including foreign persons employed by the Purchaser), without full compliance of applicable export laws, rules and regulations. Proof of compliance is the sole responsibility of Purchaser and must be provided to Iwaki America upon request prior to acceptance of orders or shipment of products.

Export Prohibition. To maintain Supplier’s eligibility to purchase government timber under the Forest Resources Conservation and Shortage Relief Act of 1990 (16 U.S.C. §620) and federal and state regulations adopted under it and laws relating to the purchase of State of Idaho timber (including IDAPA 20.02.11) (collectively, the “Export Laws”), Buyer agrees that all logs sold hereunder will be processed in the State of Idaho into end products suitable for use. Buyer shall keep such records as are necessary to evidence compliance with these restrictions under the terms of the Export Laws and not take any other action which would impair Supplier’s eligibility to purchase government timber. Buyer shall indemnify and hold Supplier harmless for and from any claims, damages, costs, losses or liabilities arising from Buyer’s violation of this Section 9 (including any damages suffered by Supplier arising out of being prohibited from buying government timber). The provisions of this Section 9 are for Supplier’s benefit only and may be waived by Supplier at any time in Supplier’s sole discretion.
