Evaluation Licenses. Access to the Software may be provided to You for beta, demonstration, test, or evaluation purposes, (collectively, “Evaluation Licenses”). For any Evaluation Licenses, the term shall be limited to thirty (30) days (the “Evaluation Period”), unless otherwise agreed to by Xxxxxxxxx in writing. Evaluation Licenses are limited specifically to use for evaluation or demonstration purposes only, and You agree not to use such Software in a production or non-test environment. Your use of the Software under an Evaluation License is provided as-is, without any representations or warranties of any kind, and is at Your sole risk. Honeywell has no obligation to support, maintain or provide any assistance regarding any Evaluation Licenses. IN NO EVENT WILL HONEYWELL BE LIABLE FOR ANY DAMAGES OF ANY KIND, INCLUDING, WITHOUT LIMITATION, ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, EXEMPLARY, STATUTORY, PUNITIVE, OR CONSEQUENTIAL DAMAGES (INCLUDING, WITHOUT LIMITATION, LOST PROFITS, LOST DATA, DAMAGE TO SYSTEMS OR EQUIPMENT, OR BUSINESS INTERRUPTION). YOU ARE NOT ENTITLED TO ANY DEFENSE, INDEMNIFICATION FOR EVALUATION LICENSES GRANTED PURSUANT TO THIS SECTION.

Evaluation Licenses. In the event you obtained a trial or evaluation version of the Software, it will come with a trial activation key that activates the Software for a limited time period (the “Trial Period”). You may use the Software during the Trial Period for internal noncommercial purposes, solely to evaluate the suitability of the Software for your needs. Upon the expiration of the Trial Period you must either purchase an activation key or destroy the Software, Documentation, all backup copies thereof, and all trial activation keys that you have obtained. If you do not purchase an activation key prior to the expiration of the Trial Period, this Agreement, and all your rights and licenses hereunder will terminate at the expiration of the Trial Period.
Evaluation Licenses. If Customer’s access to the Service is for a trial or evaluation only, then the Subscription Term shall be thirty days, or the term specified on the Order Form. Customer may not utilize the same Service for more than one trial or evaluation term in any twelve month period, unless otherwise agreed to by Rapid7. Rapid7 may revoke Customer’s trial or evaluation access at any time and for any reason. Sections 5 (Limited Warranty) and 9.1 (Indemnification) shall not be applicable to any evaluation or trial license.

OEM may use the Software during the evaluation period for internal operations, on up to two Authorized Servers, by the Authorized Users specified upon download of the Software. The evaluation period is limited to a maximum of 14 days, unless Licensor has extended such period at its sole discretion or unless a different period is stated in the applicable Sales Order.

Evaluation Licenses. If an Order Form indicates that the Software is being supplied for evaluation, then, notwithstanding anything to the contrary in this Agreement: (i) such Software must be used solely for the limited purpose of evaluating such Software; (ii) such Software is provided "as is, as available” without any warranty of any kind; (iii) Litera will have no liability for any harm or damage arising out of or in connection with such Software; (iv) Customer will not be entitled to Support Services (including any Updates); and (v) such Order Form will expire at the end of the Subscription Term set out on the applicable Order Form and will not auto renew.
Evaluation Licenses. This XXXX does not license the use of the Software for evaluation purposes (“Evaluation Software”), except to the extent these terms may be incorporated by the separate license terms and conditions accompanying that Evaluation Software. Evaluation Software is otherwise licensed without a separate agreement “As-Is” and without support or warranty of any kind, expressed or implied. ISL does not assume any liability arising from any use of the Evaluation Software. You may not publish any results of benchmark tests run on the Evaluation Software without first obtaining written approval from ISL. You authorize ISL to use any feedback or ideas you provide ISL in connection with your use of the Evaluation Software.
Evaluation Licenses. With respect to any Licensed Software provided to Licensee solely for evaluation purposes (an “Evaluation License”), in the event of conflict this Section 1.B shall prevail over any other provisions set forth in this Agreement. An Evaluation License may be used for a period of no more than thirty (30) days from the date the Licensed Software is provided to Licensee (“Evaluation Term”), unless a different period is specified in writing by Licensor. An Evaluation License may be used solely for Licensee’s internal evaluation and testing purposes on a single computer system and not for development, commercial, or production purposes. For Licensed Software subject to an Evaluation License, (i) Licensee may not reproduce or distribute the Licensed Products; and (ii) Licensee’s results of benchmark or other performance tests run on or using the Licensed Software may not be disclosed to any third party without Licensor’s prior written consent. At any time during the Evaluation Term or upon completion thereof, Licensee may, upon written notification to Licensor and payment of the applicable license fee, replace the Evaluation License with a license to use the Licensed Software that is not restricted to evaluation purposes. In the absence of such notification by Licensee, the Evaluation License shall automatically terminate at the end of the Evaluation Term, and Licensee shall return, or, if Licensor so directs, delete and destroy all such Licensed Software and provide Licensor with written confirmation of its compliance with this provision. Upon written request from Licensee, Licensor may, in its sole discretion, grant Licensee an extension in writing prior to the expiration of the Evaluation Term. Other than updates to Licensed Software provided as part of support and maintenance, Licensed Software provided by Licensor free of license fee charge shall be deemed to be provided for evaluation purposes only. Licensed Software furnished under an Evaluation License is provided without any contractual obligation of maintenance and support by Licensor and is provided “as is” without warranties, implied or express, of any kind.
