Early Delivery. In the event that the BUILDER believes that the VESSEL can be completed and ready for Delivery on a date earlier than the Contractual Delivery Date, then the BUILDER may give a written notice to the BUYER, no later than six (6) months before the revised date (the “Early Delivery Date”) informing the approximate date on which the VESSEL can be ready for the Delivery. The BUYER shall have the option, but not the obligation, to accept Delivery of the VESSEL on the Early Delivery Date and upon the BUYER’s acceptance thereof, the parties shall discuss the specific amount of the additional payment due to the BUILDER for the accelerated Delivery of the VESSEL on the Early Delivery Date at the delivery stage of the VESSEL and the compensation payment of the acceleration bonus shall be settled and paid in full with the final delivery instalment concurrently uponwith the actual Delivery and acceptance of the VESSEL by the BUYER. If the Parties fail to reach a mutual agreement on the amount of the Early Delivery bonus, the BUILDER shall be free to deliver the VESSEL on the original Contractual Delivery Date or earlier at its option. The Parties hereto acknowledge that there will be no liquidated damages or other penalty to be imposed on the BUILDER in the event the VESSEL happens to be delivered on any date later than the Early Delivery Date but earlier than the original Contractual Delivery Date.
Early Delivery. Xyratex has the right to return to the Supplier, at the Supplier’s expense, any Goods delivered more than 5 days before the agreed delivery date.
Early Delivery. If the Customer receives Goods before it has signed the Lease Schedule relating to those Goods, the Customer must comply with the terms and conditions of the Lease in respect of those Goods from the time of receipt.
Early Delivery. Surplus delivery SEPHORA reserves the right to return deliveries which are delivered more than five days before the planned date, at the Supplier’s costs and risks, as well as to refuse quantities which are above or below 5% of the quantities ordered and/or refuse services which are performed in advance, as well as those which are not stipulated in the purchase order.
Early Delivery. If Product is available for delivery to Principal prior to the specified or requested delivery date, Principal shall make reasonable effort to accept the Product. Otherwise, Agent shall be responsible for arranging the Product to be properly stored and redelivered on the specified or requested delivery date.
Early Delivery. Unless the property is not yet prepared for delivery, and if the Home is available for delivery before the scheduled date, and the Seller desires to deliver it, then Buyer shall accept early delivery upon reasonable notice from Seller.
Early Delivery. Supplier's signature on the Order confirms Supplier's agreement to the terms herein. Notwithstanding the foregoing, if delivery is made prior to Supplier's signing this Order, Supplier's delivery of the Materials will constitute its unqualified acceptance of all the terms of this Order, including the transfer of copyright to Client.
Early Delivery. No Products should be delivered prior to the time agreed in the Purchase Agreement as the earliest time for delivery without the prior written consent of the Purchaser.
Early Delivery. SELLER may deliver Products prior to the Scheduled Delivery Date provided that, with respect to delivery occurring more than three (3) days prior to the Scheduled Delivery Date (“Early Delivery”), SELLER obtains BUYER’s written consent at least three (3) working days prior to the delivery date desired by SELLER. In the event of an Early Delivery without BUYER’s prior written consent, BUYER may, at its sole discretion, (i) accept the Early Delivery and process the relevant invoice as if the Products were delivered on the Scheduled Delivery Date; or (ii) arrange for the return of the Early Delivery to SELLER at SELLER’s cost and expense in a transport manner comparable to the delivery transport manner; provided, that in such event, BUYER shall have absolutely no liability for any damage or loss for the Early Delivery.
Early Delivery. Arm may refuse any delivery of Work made before the Delivery Date and Supplier will re-deliver the Products on the Delivery Date at Supplier’s expense.
