Customer Disputes. Agency agrees to maintain records of any disputes, threats of lawsuits or actual lawsuits involving any Referred Accounts. Agency agrees to provide access to Client to copies of any written complaint received from the obligor concerning the Agency’s handling of a Referred Account as well as the response made or action taken by Agency. Client reserves the right to recall any Referred Account as a result of a customer complaint.

Customer Disputes. Builder shall be solely responsible for the resolution of any and all disputes between Builder’s customers and Builder. Failure to resolve disputes associated with the Florida Water StarSM features may result in removal of Builder from the Program.

Customer Disputes. If any litigation, arbitration or mediation proceeding is pending or threatened by or between Buyer and its customer or another third party relating to the subject matter of the Agreement, Seller will consent to and submit to the jurisdiction of and be joined in that litigation, arbitration or mediation proceeding upon the request of Buyer, and will agree to be bound by all orders, rules and awards entered in that proceeding, which, in the case of arbitration, will be final and binding on the parties.
Customer Disputes. In the event (a) there is an arbitration, legal, or other equitable action or proceeding involving Buyer and its Customer in a jurisdiction and venue that is not the jurisdiction and venue under Sections 28.1 or 28.2, as applicable (each, an “Alternative Jurisdiction”) and (b) such arbitration, action, or proceeding relates to the Goods or this Contract, then, at Buyer’s option, (i) Seller agrees to submit to the Alternative Jurisdiction, (ii) the Parties agree that the sole and exclusive forum and venue for any legal or equitable action or proceeding arising out of, or in connection with, this Contract will lie in the Alternative Jurisdiction; or (iii) both.

Xxxxxxxx agrees to provide PayTomorrow with any and all notes, records, receipts, and any and all other documents that may relate to any claim or dispute as reasonably requested by PayTomorrow, within five (5) days of receipt of such written request for such documentation.
