Customer Commitment. During the period that United places its designator code on flights operated by Contractor, Contractor will adopt and follow plans and policies comparable (to the extent applicable and permitted by law and subject to operational constraints) to United’s Customer Commitment as presently existing and hereafter modified. Contractor acknowledges that it has received a copy of United’s presently existing Customer Commitment. United will provide Contractor with any modifications thereto promptly after they are made. EXHIBIT C Non-Revenue Pass Travel United will have the sole right to design, implement and oversee a pass travel program for the Regional Air Services. EXHIBIT D Fuel Services AGREEMENT FOR FUEL SERVICES This Agreement for Fuel Services (this “Agreement”), dated _________ (the “Effective Date”) is entered into by and between __________________, a _________ __________ with its principal offices at _________________ (“Airline”) and ________, with its principal offices at _________________ (“Service Provider”).
Customer Commitment. The Customer agrees to authorize the ESCO to proceed with the creation of an Energy Savings Plan, final development and engineering for, at minimum, a self-funding and cash flow positive ESIP Project Only – Self Funding and Cash Flow Positive Scope, as listed in Attachment A and subject to the customer’s approval, the independent third party reviewer, and the NJBPU approval. Following third party review and approval of the Energy Savings Plan, the Customer shall take action to adopt the Energy Savings Plan within thirty (30) days, subject to approval of same by the NJBPU. Once adopted by the Customer, the ESCO shall submit the Energy Savings Plan to the NJBPU for review and approval. Following receipt of NJBPU approval of the Energy Savings Plan, the ESCO shall present a complete contract to the Customer and the Customer shall take formal action concerning said contract within forty-five (45) days.
Customer Commitment. Customer will use the Service and Documentation in compliance with all applicable laws and regulations. Customer will procure all rights, consents and privileges to: (a) obtain and transfer Customer Data to Allovue; (b) permit Allovue to collect, access, and use Customer Data in accordance with the terms of this Agreement; and (c) grant the rights and licenses in Section 3.1 (Usage). Customer will ensure that the provision of Customer Data to Allovue and Allovue’s collection, access, and usage of Customer Data will comply with all applicable laws and regulations, including all privacy laws and regulations. Customer shall be responsible for and assumes the risk, responsibility and expense of any problems resulting from, the accuracy, quality, integrity, legality, reliability, and appropriateness of all Customer Data. The delivery of the Customer Data shall not, under any circumstances, create any implication that the information contained therein is correct, and Allovue does not undertake an obligation to update such information at any time after the date noted therein.
