Copy of Notice of Default to Mortgagee. Whenever a party shall deliver any notice or demand to a defaulting party with respect to any breach or default by defaulting party of its obligations or covenants in this Agreement, the party delivering such notice or demand shall at the same time forward a copy of such notice or demand to each holder of any mortgage, deed of trust or similar method of encumbrance (collectively "Mortgage”) at the last address of such Mortgage holder as shown in the records of the Register of Deeds of Lancaster County as provided in such Mortgage of the defaulting party.
Copy of Notice of Default to Mortgagee. Whenever the City shall deliver any notice or demand to Developer with respect to any Default by Developer in its obligations or covenants under this Agreement, the City shall at the same time forward a copy of such notice or demand to each holder of any mortgage authorized by this Agreement at the last address of such holder shown in the records of the City.
Copy of Notice of Default to Mortgagee. If the Authority delivers any notice or demand to Developer, or any successor in interest to Developer, with respect to any Default under this Agreement, the Authority will use its best efforts to also deliver a copy of such notice or demand to the mortgagee of any Mortgage at the address of such mortgagee provided in the recorded Mortgage or any other address thereafter provided to the Authority in a written notice from Developer, any successor in interest to Developer or the mortgagee, provided that failure of the Authority to give any such notice shall not limit the Authority’s ability to exercise any of its remedies hereunder.
Copy of Notice of Default to Mortgagee. If City delivers any notice or demand to LPC West with respect to any breach of or default by LPC West in its obligations or covenants under this Agreement, City shall at the same time send a copy of such notice or demand to each Mortgagee at the last address of such holder shown in the records of City and if no such address is shown in City’s records, then as show in any Mortgage of record.
Copy of Notice of Default to Mortgagee. Whenever Herndon shall deliver any notice or demand to Xxxxxxxx with respect to any breach or Default by Xxxxxxxx in its obligations or covenants under this Agreement in accordance with Section 21.7 or otherwise, Herndon shall at the same time forward a copy of such notice or demand to each Approved Mortgagee, at the last address of such Approved Mortgagee provided to Herndon.
Copy of Notice of Default to Mortgagee. If the Authority or the City delivers any notice or demand to the Redeveloper, or any successor in interest to the Redeveloper, with respect to any default under this Agreement, and prior to exercising any remedy available to it due to such default, the Authority or the City, as the case may be, will use its best efforts to also deliver a copy of such notice or demand to the mortgagee of any Mortgage at the address of such mortgagee provided to the Authority in a written notice from the Redeveloper, any successor in interest to the Redeveloper or the mortgagee.
Copy of Notice of Default to Mortgagee. Whenever the Authority shall deliver any notice or demand to One Ardmore with respect to any breach or default by One Ardmore, the Authority shall at the same time forward a copy of such notice or demand to each holder of any mortgage authorized by this Agreement at the last address of such holder shown in the records of the Authority.
Copy of Notice of Default to Mortgagee. Whenever the City shall deliver any notice or demand to the Developer with respect to any breach or default by the Developer in its obligations or covenants under this Agreement, the City shall, at the same time, forward a copy of such notice or demand to each Mortgagee permitted under the terms of this Agreement at the last address of such Mortgagee set forth in the latest notice delivered to the City. Failure to deliver such notice shall make the notice of default invalid for all purposes until such copy is delivered to each Mortgagee. If the default is specific to a particular Parcel, then City shall only provide notice to the Mortgagee of such Parcel.
Copy of Notice of Default to Mortgagee. Whenever the City shall deliver any notice or demand to the Redeveloper with respect to any breach or default by the Redeveloper of its obligations or covenants in this Agreement, the City shall at the same time forward a copy of such notice or demand to each holder of any mortgage authorized by this Agreement at the last address of such holder as shown in the records of the City or as provided by such mortgagee.
Copy of Notice of Default to Mortgagee. If Owner delivers any notice or demand to DOSO with respect to any breach of or default by DOSO in its obligations or covenants under this Agreement, Owner shall at the same time send a copy of such notice or demand to each Mortgagee at the last address of such holder shown in the records of Owner.
