Contract Penalty. The CONSULTANT shall pay to the CITY the amount of $ 100.00 Dollars per calendar day for unexcused delay in completion of the project past the date of completion.
Contract Penalty. If a contract penalty has been agreed upon, the Company is entitled to claim such penalty until the final payment is due without requiring a reservation pursuant to section 341 paragraph 3 of the German Civil Code (“BGB”).

Contract Penalty. 9.1 In the event that the bidder does not or only partially fulfils his contractual obligations or does not fulfil them in due time he is obliged to pay a contract penalty, for each day during which at least one violation occurred, in the amount of the double net-monthly fee agreed upon according to fig. 5 for the respective load flow commitment. This is not applicable in case of force majeure in the sense of Article 7 of this contract, in case the bidder is not already in default at the occurrence of force majeure. For load flow commitments which include a commodity charge the basis for the calculation of the penalty is a theoretical call of the LFC with 20 % during the contract period.
Contract Penalty. In the case of an intentional breach of contractual provisions despite a pri- or written warning from Meteotest, the User must pay a contract penalty of CHF 3’000.00 per instance of breach, without prejudice to any claim relating to performance of the Agreement (Art. 160 para. 1 SCO).
Contract Penalty a. Shall the Partner breach his duties resulting these Terms, a penalty in the amount of EUR 100.000.— shall be agreed. Any of starlim-xxxxxxx’x damage resulting from Partner breaching these duties and exceeding this amount shall be compensated to its full extent.

In the event that the bidder does not fulfil his contractual obligations or does not fulfil them in due time he is obliged to pay a contract penalty in the amount of the double fee agreed upon according to fig. 5 for the respective load flow commitment for the whole contract period. For bids which include a commodity charge the basis for the calculation of the penalty is a theoretical call up of the LFC with 40 % during the contract period.
Contract Penalty a. Shall the Purchaser breach his duties resulting from item 2.c. 12.b. und 13.b. of these Terms, a penalty in the amount of EUR 150.000.— shall be agreed. Any of starlim’s damage resulting from Purchaser breaching these duties and exceeding this amount shall be compensated to its full extent.
Contract Penalty. In the event of any breach of this Agreement, Licensor may, in its sole discretion, decide to suspend or terminate any further business with Licensee including, but not limited to: (1) canceling any of Licensee’s open orders for Licensor’s product; and (2) rejecting any and all future orders by Licensee for Licensor’s product.
Contract Penalty. If a contract penalty has been agreed upon and is incurred, the Principal is entitled to claim statutory indemnification, in amount exceeding the contract penalty.
