Construction Charges. Qwest will provide necessary construction only to the extent required by applicable law.
Construction Charges. 9.5.1 Qwest will conduct an individual financial assessment of any request that requires construction of network capacity, facilities, or space. When Qwest constructs to fulfill WSP's request, Qwest will bid this construction on a case-by-case basis. Qwest will charge for the construction through nonrecurring charges and a term agreement for the remaining recurring charge, as described in the Construction Charges Section. When WSP orders the same or substantially similar service available to Qwest End User Customers, nothing in this Section shall be interpreted to authorize Qwest to charge WSP for special construction where such charges are not provided for in a Tariff or where such charges would not be applied to a Qwest End User Customer.
Construction Charges. 19.1 All rates, charges and initial service periods specified in this Agreement contemplate the provision of network Interconnection services and access to Unbundled Loops or ancillary services to the extent existing facilities are available. Except for modifications to existing facilities necessary to accommodate Interconnection and access to Unbundled Loops or ancillary services specifically provided for in this Agreement, CenturyLink will consider requests to build additional or further facilities for network Interconnection and access to Unbundled Loops or ancillary services, as described in the applicable section of this Agreement.
19.2 All necessary construction will be undertaken at the discretion of CenturyLink, consistent with budgetary responsibilities, consideration for the impact on the general body of End User Customers and without discrimination among the various Carriers.
19.3 A quotation for CLEC's portion of a specific job will be provided to CLEC. The quotation will be in writing and will be binding for ninety (90) business days after the issue date. When accepted, CLEC will be billed the quoted price and construction will commence after receipt of payment. If CLEC chooses not to have CenturyLink construct the facilities, CenturyLink reserves the right to ▇▇▇▇ ▇▇▇▇ for the expense incurred for producing the engineered job design.
19.4 In the event a construction charge is applicable, CLEC's service Application Date will become the date upon which CenturyLink receives the required payment.

23.2 Resale Construction charges associated with the resale of services will be applied in the same manner that construction charges apply to USWC's retail end users. Contracts may be negotiated on an individual case basis when construction is required for large retail or resale customers.

If Paging Provider chooses not to have Qwest construct the facilities, Qwest reserves the right to bill Paging Provider for the expense incurred for producing the engineered job design.
16.4. In the event a construction charge is applicable, Paging Provider’s service application date will become the date upon which Qwest receives the required payment.
1. FACILITY CHARGES- All rates and charges are defined in Exhibit A.
A. Type 1
(i) Between the Serving Wire Center serving Paging Provider’s POC , Qwest will provide if applicable all facilities including the NAC or Channel Facility, Connectivity, Dial Outpulsing, Channel Performance, Multiplexing and Dedicated Transport at no charge to Paging Provider.
B. Type 2
(i) Subject to Section 2.6.7.1, Paging Provider shall be obligated to pay at the rates described in Exhibit A for the portion of the facilities used to deliver Third Party Traffic based on the following applicable Third Party Traffic percentage, as follows: AZ 21.1% CO 26.2% IA 26.1% ID 24% MN 22.7% MT 26% ND 26% NE 22.8% NM 13.7% OR 31.45% SD 26% UT 17.05% WA 20% WY 24%
C. 100% of the Non recurring charges incurred due to Paging Provider relocation or equipment change will be paid.
Construction Charges. Subject to the requirements in Section 9.1.2 of the Agreement, Qwest will conduct an individual financial assessment of any request that requires construction of network capacity, facilities, or space for access to or use of UNEs. When Qwest constructs to fulfill CLEC's request for UNEs other than pursuant to terms and conditions applicable to Qwest’s retail End User Customers, Qwest will bid this construction on a case-by-case basis. Qwest will charge for the construction through non-recurring charges and a term agreement for the remaining recurring charge, as described in the Construction Charges Section of the equivalent retail service Tariff or alternatively at CLEC’s election through an advance payment of a Special Construction price quote. Qwest will impose these Construction charges only when Qwest agrees to construct facilities in response to (a) CLEC requests for UNEs outside of Qwest’s current service area or (b) CLEC requests for UNEs at a location that is served by facilities that are already at full capacity and the CLEC request would require Qwest to construct facilities in larger quantities or at a higher grade of service than Qwest provides to its Retail End User Customer or when CLEC elects to request construction in lieu of having an order held for lack of available facilities. Qwest will treat the CLEC's order consistently with how Qwest would treat a Retail End User Customer order for services that require construction of comparable facilities. When CLEC orders the same or substantially similar service or facilities available to Qwest Retail End User Customers, nothing in this Section shall be interpreted to authorize Qwest to charge CLEC for special construction where such charges are not provided for in a Tariff or where such charges would not be applied to a Qwest Retail End User Customer. If Qwest agrees to construct facilities that satisfies the description of one (1) or more UNEs contained in this agreement, those facilities shall be deemed UNEs. The request process for UNE construction is sometimes referred to as “Competitive Local Exchange Carrier (CLEC) Requested Unbundled Network Elements (UNE) Construction” or “CRUNEC”. The request process for UNE construction is not required for requests that can be resolved as described in Section 9.1.2.1.1.
9.19.1 To initiate the construction of additional UNE facilities, CLEC must submit a request by contacting the Qwest Service Manager.
Construction Charges. All Services and pricing are subject to site survey. After the Effective Date, BT will arrange for any survey(s) to be conducted to confirm the availability of a suitable access line to the Site(s). If the survey(s) identify that additional engineering work is required in order to provide a suitable access line to the Site(s) and:
7.15.1 the Excess Construction Charges are within the limit the Customer has agreed to in the Order BT will proceed with delivering the Service for the affected Site(s) following the completion of any additional engineering works; or
7.15.2 the Excess Construction Charges are in excess of the limit the Customer has agreed to in the Order or there are no Excess Construction Charges set out in the Order, BT may provide a new quote to the Customer, detailing the additional Excess Construction Charges the Customer will need to pay for the engineering work to be completed. If the Customer:
(a) accepts the new quote, BT will proceed with delivering the Service for the affected Site(s) following the completion of any additional engineering works; or
(b) does not accept the new quote, BT will cancel the provision of the Service to the affected Site(s) and BT will have no obligation to provide the Service to the Customer at that Site. The Parties will agree any amendments required to minimum commitments if applicable.
