Condominium Units. The Condominium Units, or a portion thereof, shall be constructed at the option of the Company, subject to the Bank's reasonable approval of the design concept, schematics, plans and specifications for the Condominium Units. If constructed, all or a portion of the Condominium Units may be operated by Williams as part of a rental arrangement providing for up to 450 hotel rooms. If the Bank has approved the design concept, schematics, plans and specifications for the Condominium Units and subject to the Bank's receipt of evidence satisfactory to the Bank that adequate financing is available for the completion of the Condominium Units and that the legal relationship between the Condominium Units and the Project is appropriate and enforceable, and provided no Default or Event of Default exists or is continuing hereunder or under any of the other Operative Documents, portions of the Condominium Parcels will be released from the lien of the Fee Mortgage upon the transfer of such property to the entity which will develop the Condominium Units, with no consideration payable to the Bank therefor, other than amounts payable pursuant to Paragraphs 7(p) or 14(c) hereof. The Bank shall subordinate the Fee Mortgage to necessary easements reasonably approved by the Bank for access roads to and utilities serving the Condominium Parcels so released. Notwithstanding the release of all or any of the Condominium Parcels from the lien of the Fee Mortgage, the Condominium Revenues shall continue to be included in the Collateral given by the Company in connection with the Letter of Credit, this Agreement and the Bonds, and any such release by the Bank shall be subject to the Bank's prior receipt of a fully executed Assignment of Rents in connection therewith.
Condominium Units. The leasehold condominium units and undivided interest in the Condominium common elements appurtenant thereto all as more particularly described in Exhibit "A" attached hereto (collectively, the "UNIT"), all located in the building known as "The New York Times Building" having a street address of 620 Eighth Avenue, New York, New York (the "BUILDING"). The land upon which the Building is constructed and which constitutes a part of the Condominium is herein referred to as the "LAND"; and
Condominium Units. Solely with respect to REO Properties which are condominium units, no Seller or any Affiliate is a "sponsor" or a nominee of a "sponsor" under any plan of condominium organization affecting the unit and the ownership and sale of any condominium unit will not violate any federal, state or local law or regulation regarding condominiums or require registration, qualification or similar action under such law or regulation.

Condominium Units. Tenant and landlord have discussed the fact that the premises are held in or will be held in an Illinois limited partnership known as THE RAND-OLIVE ASSOCIATES, and tenant acknowledges-that fact, and, further, tenant acknowledges that the intended leasing and operation of the premises contemplates the causing of the premises to be submitted to the provisions of the Condominium Property Act of the State of Illinois, as amended from time to time, and the sale or other disposition of condominium unit ownership in the condominium property thereby created. Notwithstanding the foregoing, it is understood and agreed that neither landlord nor its successor shall have any affirmative obligation to convert the property to condominium, and in the event the property shall not be converted to condominium then, subject to the provisions of Section 1-4, this lease shall be and remain in full force and effect.
Condominium Units. (a) The Blue Mountain Condominium Units, a complete description of which are set forth in Exhibit A-1 of this Agreement and by this reference incorporated herein, together with all and singular the rights and appurtenances pertaining to the Blue Mountain Condominium Units, including any right, title, and interest of Sellers in and to all parking, garage, or storage units, the common elements relating to the Blue Mountain Condominium Units, and all other rights and interests appurtenant to the Blue Mountain Condominium Units (collectively, the “Blue Mountain Condominium Property”).
