Commitment Level Clause Samples
The Commitment Level clause defines the degree of obligation each party has under the agreement. It specifies whether commitments are binding or non-binding, and may outline the extent to which parties are required to perform certain actions or deliverables. For example, it can clarify if a party is merely expressing intent or is legally required to fulfill specific duties. This clause ensures both parties have a clear understanding of their responsibilities, reducing the risk of disputes over expectations and enforceability.

Commitment Level. During the Delivery Term, Seller shall make available to Buyer the Commitment Level corresponding to each Product. In addition, when Buyer provides Seller with Notice of a DR Event, Seller shall then provide the Product equal to or greater than the Commitment Level indicated in Table 3.2.1. Seller may revise the Commitment Levels as set forth in the following Table 3.2.2. If Seller is providing more than one type of Product that includes Product Type Reference A or B, Seller shall provide to Buyer a completed Commitment Level chart for each Product selected in the form attached as Appendix IV to indicate LCA by Delivery Season in each Contract Year by February 1st of the Delivery Season.
Commitment Level. ReadyChek will provide a mean time to restore, that is the time it takes to restore service once the system has been detected as being down, of one (1) hour to the Software during the SaaS Term.
Commitment Level. At a minimum, End User will pay the minimum annual service fee for a minimum term of one (1) year from the initiation of the Service.

Commitment Level. The Applicant agrees to a first year commitment level (the "First Year Commitment Level") equal to nine (9) multiplied by the Commitment Level set out above, which dollar level is based on the Applicant's annual Service usage of AT&T Canada - Toll-Free, Unison and VROUTE switched voice services. The Applicant agrees to an annual commitment level (the "Annual Commitment Level") equal to twelve (12) multiplied by the Commitment Level set out above, which dollar level is based on the Applicant's annual Service usage of AT&T Canada - Toll-Free, Unison and VRoute switched voice services.
Commitment Level. Eastbay will provide 99.9% “availability” to the Software during the SaaS Term, calculated on a monthly basis. If Eastbay provides 99.7% or less availability in any given calendar month, Eastbay shall credit ten (10%) percent of the Subscription Fee for such month to the Client to be applied against the Subscription Fee for the next Renewal Term. If Eastbay provides 99.5% or less availability in any given calendar month, Eastbay shall credit twenty (20%) percent of the Subscription Fee for such month to the Client to be applied against the Subscription Fee for the next Renewal Term.

Any Customer may purchase Products at the prices set forth on Exhibit A if the Customers collectively commit to purchase exclusively from Supplier (in the form of Products) [*] of the Customers’ quarterly requirements for items substantially similar to Products (the “Commitment Level”).
