The Class Administrator clause designates an individual or entity responsible for managing and overseeing the administration of a class action settlement or proceeding. Class Administrator. The Class Administrator shall assist with various administrative tasks including, without limitation:
Class Administrator. The eligible class of persons for Performance-Based Awards under this Section 5.2 shall be officers and employees of the Corporation or one of its Subsidiaries. The Administrator approving Performance-Based Awards or making any certification required pursuant to Section 5.2.4 must be constituted as provided in Section 3.1 for awards that are intended as performance-based compensation under Section 162(m) of the Code.
Class Administrator. The Class Administrator shall be responsible for administration of this Settlement. The Class Administrator shall be allowed to communicate freely with the Parties’ counsel, and will provide updates on a monthly basis to and as requested by the Parties’ counsel.
Class Administrator. The Class Administrator shall assist with various administrative tasks including, without limitation:
(a) Establishing and operating the Settlement Fund;
(b) Arranging for the dissemination of the Class Notice pursuant to the Notice Plan agreed to by the Parties and approved by the Court;
(c) Making any mailings required under the terms of this Agreement or any Court order or law, including handling returned mail;
(d) Answering inquiries from Class Members and/or forwarding such inquiries to Class Counsel;
(e) Receiving and maintaining Requests for Exclusion;
(f) Establishing a Settlement Website;
(g) Establishing a toll-free informational telephone number for Class Members;
(h) Receiving and processing (including monitoring for fraud and validating or rejecting) Class Member claims and distributing payments to Class Members;
(i) Providing regular updates on the claims status to counsel for all Parties; and
(j) Otherwise assisting with the implementation and administration of the Settlement.
Class Administrator. CPT Group, Inc. shall serve as class administrator (the “Class Administrator”) for purposes of administering this Settlement and shall receive a professional fee of $30,000 (the “Class Administrator Fee”), which shall be paid solely out of the Class Settlement Amount. The Parties represent that they do not have any financial interest in the Class Administrator or otherwise have a relationship with the Class Administrator that could create a conflict of interest.
Class Administrator. (a) The Defendants shall provide up to $500,000 to cover the costs of the Class Administrator. Should any amount of the $500,000 remain following the conclusion of settlement administration, it shall be distributed to the Class.
(b) The Class Administrator shall be selected by mutual agreement of the Parties.
(c) The Class Administrator is responsible for:
(i) the distribution of direct and indirect notices to the Class; and
(ii) payment of all funds to the Class; and
(iii) all aspects of the administration of the settlement in keeping with this Settlement Agreement and any Court Orders.
(d) The Class Administrator will be solely responsible for all aspects of the settlement for the Class following notice, including but not limited to distribution to the Class and reporting to the Court.
(e) The Class Administrator shall execute an agreement with the Defendants on the sharing of data on the Class. The agreement will be prepared by the Defendants and must be satisfactory to the Defendants.
(f) After settlement approval and a court order substantially in the form of Schedule E, the Defendants will provide to the Class Administrator, to the extent the information is available to them, the following information for the Class: (i) the business number of the entity that was the employer at the time of departure; (ii) the first and last name of the former employee; (iii) SIN; (iv) employee identification number; (v) date of birth; (vi) date of hire; (vii) date of departure;
Class Administrator. Class Action Administration Inc. (“CAA”) of Westminster, Colorado (“Class Action”), who will be retained by Class Counsel.
Class Administrator. Simpluris, Inc. shall serve as class administrator (the “Class Administrator”) for purposes of administering this Settlement Agreement and shall receive a professional fee (the “Class Administrator Fee”), which shall be paid solely out of the Class Settlement Amount in the estimated amount of $38,000 and not to exceed $45,000. The Parties represent that they do not have any financial interest in the Class Administrator or otherwise have a relationship with the Class Administrator that could create a conflict of interest.
Class Administrator. Subject to the Court’s approval, the Parties agree to retain Postlethwaite & ▇▇▇▇▇▇▇▇▇▇▇ (“P&N”) as the Class Administrator to effect Class Notice and Claims Administration. The Class Administrator shall assist with various administrative tasks including, without limitation:
(a) Arranging for the dissemination of the Class Notice pursuant to the Notice Plan agreed to by the Parties and approved by the Court;
(b) Making any mailings required under the terms of this Agreement or any Court Order or law, including handling returned mail;
(c) Answering inquiries from Class Members and/or forwarding such inquiries to Class Counsel;
(d) Receiving and maintaining forms of Class Members who wish to opt out of and be excluded from the Settlement;
(e) Establishing a Settlement Website;
(f) Establishing a toll-free informational telephone number for Class Members;
(g) Receiving and processing (including monitoring for fraud and validating or rejecting) Class Member claims and distributing payments to Class Members; and
(h) Otherwise assisting with the implementation and administration of the Settlement.
