Cart. “Cart” means a heavy plastic receptacle with a rated capacity of at least twenty (20) 199 and not more than one hundred (100) gallons, having a hinged tight-fitting lid and wheels, that is provided 200 by the Exclusive Franchise Solid Waste Contractor, approved by the City, and used by Service Recipients 201 for collection, accumulation, and removal of solid waste from commercial, industrial, or residential premises 202 in connection with Exclusive Franchise Collection Services. The specifications for Contractor-provided Carts 203 are set forth in Exhibit 4. 204 1.20 CERCLA. The Comprehensive Environmental Response, Compensation and Liability Act 205 of 1980, 42 U.S.C. Cart. May be used to refer to a Garbage Cart, Organics Cart or Recycling Cart.
Cart. Upon notification to CONTRACTOR by the TOWN or a Customer that a Residential Collection Service Unit’s Cart has been stolen or damaged, the CONTRACTOR upon verification shall deliver a replacement Cart or make repairs to the Container within two (2) Work Days of said notice. Each Residential Collection Service Unit shall be entitled to two (2) repairs or two (2) replacements of lost, destroyed, or stolen Containers within a rolling 24 month period at no cost to the TOWN or the Residential Collection Service Unit. Additional replacement Containers or repairs shall be provided at the CONTRACTOR’S actual cost and charged to the Residential Collection Service Unit Customer, unless such damage was caused by CONTRACTOR.

Cart. ‘Cart’ means a plastic Container with wheels and a hinged lid with a capacity from 35 to 101 gallons, which is typically emptied by an automated side-loading collection vehicle.
