Building Area. Following approval of the Scope of Development, the Parties shall meet and confer to determine the appropriate usable square footage of the proposed Project improvements and necessary site footprint to accommodate the proposed Project improvements (the “Building Area”). Such square footage and site footprint shall be approved by the Parties in the time set forth in the Schedule of Performance.

Building Area. Concessionaire agrees that no improvement shall be erected, placed upon, operated or maintained within, on or near the Premises, nor any business conducted or carried on therein or therefrom, in violation of the terms of this Contract, or in violation of any regulation, order of law, statute, bylaw or ordinance of a governmental agency having jurisdiction over the Premises without first obtaining the written approval of the Landlord.

As to the Gasoline Sales Area, the same may be replaced by a building provided (a) such building is within the building limit lines in such location, (b) the area surrounding such replacement building is improved as Automobile Parking Area as depicted on the New Site Plan detail for such replacement building and (c) the parking ratio requirements with respect to such replacement building are satisfied on the Costco Tract including such replacement building.
