Borrower Not Released. Extension of the time for payment or modification of amortization of the sums secured by this Deed of Trust granted by Lender to any successor in interest of Borrower shall not operate to release, in any manner, the liability of the original Borrower, nor Borrower’s successors in interest, from the original terms of this Deed of Trust. Lender shall not be required to commence proceedings against such successor or refuse to extend time for payment or otherwise modify amortization of the sums secured by this Deed of Trust by reason of any demand made by the original Borrower nor Borrower’s successors in interest.
Borrower Not Released. Extension of the time for payment or modification of amortization of the sums secured by this Mortgage granted by Xxxxxx to any successor in interest of Borrower shall not operate to release in any manner the liability of the original Borrower and Xxxxxxxx's successor in interest. Lender shall not be required to commence proceedings against such successor or refuse to extend time for payment or otherwise modify amortization of the sums secured by this Mortgage by reason of any demand made by the original Borrower and Xxxxxxxx's successors in interest.
Borrower Not Released. Forbearance By Lender Not a Waiver. Extension of the time for payment or modification of amortization of the sums secured by this Mortgage granted by Xxxxxx to any successor in interest of Borrower shall not operate to release the liability of the original Borrower or Xxxxxxxx’s successors in interest. Lender shall not be required commence proceedings against any successor in interest or refuse to extend time for payment or otherwise modify amortization of the sums secured by this Mortgage by reason of any demand made by the original Borrower or Xxxxxxxx’s successors in interest. Any forbearance by Xxxxxx in exercising any right or remedy shall not be a waiver of or preclude the exercise of any right or remedy.
Borrower Not Released. Without affecting any obligation of Borrower under this Agreement, Lender without notice or demand may renew, extend or otherwise change the terms and conditions of the Loan.
Borrower Not Released. Lender may from time to time, either before or after the maturity of the Obligations, take any one or more of the following actions without affecting the liability of Borrower or any other person (except any person expressly released in writing) under the Note, this Agreement or the other Transaction Documents, and without affecting the rights of Lender with respect to any security not expressly released in writing: (i) release any person or entity liable for payment of all or any part of the Obligations or for performance of any obligation contained in the Transaction Documents; (ii) make any agreement extending the time or otherwise altering the terms of payment of all or any part of the Obligations, or modifying or waiving any obligation in the Transaction Documents, or subordinating, modifying or otherwise dealing with the lien or charge hereof; (iii) exercise or refrain from exercising or waive any right Lender may have W1der this Agreement, under the Transaction Documents, or otherwise available under applicable law; (iv) accept additional security of any kind; or (v) release or otherwise deal with any property, real or personal, seeming the Obligations.
Borrower Not Released. Extension of the time for payment, or modification or amortization of the sums secured by this Mortgage granted by the Lender to any successor in interest of the Borrower, shall not operate to release in any manner the liability of the original Borrower and the Borrower's successor in interest. Lender shall not be required to commence proceedings against such successor, or refuse to extend time for payment or otherwise modify or amortize of the sums secured by this Mortgage, by reason of any demand made by the original Borrower and the Borrower's successors in interest.
Borrower Not Released. The exercise by the Agent of any of --------------------- the rights hereunder shall not release the Borrower from any of its or his duties or obligations under any agreement with the Agent, the Secured Parties or each other and neither the Agent nor any other Secured Party shall have any obligation or liability under any such agreement by reason of this Agreement, nor shall the Agent or any other Secured Party be obligated to perform any of the obligations or duties of the Borrower thereunder or to take any action to collect or enforce any claim for payment assigned hereunder.
Borrower Not Released. Extension of the time for payment or modification of amortization of the sums secured by this Trust Deed granted by Xxxxxx to Borrower shall not operate to release the liability of Borrower. Any forbearance by Lender in exercising any right or remedy including, without limitation, Lender’s acceptance of payments from third persons or entities or in amounts less than the amount then due, shall not be a waiver of or preclude the exercise of any right or remedy.
Borrower Not Released. Nothing in this Article 4 shall limit, reduce or otherwise affect Borrower’s obligations to make payments of the monthly interest payment and, if applicable, principal payment then due under the Notes. Section 4.3
