ARTICLE MANAGEMENT FUNCTIONS. The Union acknowledges and recognizes that the management of the Employer's operations and direction of the working force are fixed exclusively with the Employer and shall remain solely with the Employer except as limited by an express provision of the Agreement. Without restricting the generality of the foregoing, the Union acknowledges that it is the exclusive function of the Employer to:

ARTICLE MANAGEMENT FUNCTIONS. The Union recognizes the rights conferred upon the Corporation by Statute and the rights of the Corporation to hire, promote, demote, transfer, suspend or otherwise discipline and discharge an employee for proper cause; provided that a claim of discriminatory promotion or demotion, or a claim that an employee has been discharged or disciplined without proper cause, may be the subject of a grievance and dealt with under the provisions of Article of this Agreement. The Union further recognizes the undisputed right of the Corporation to operate and manage its business in all aspects in accordance with its responsibilities. In addition, the location of its plants or places of employment, the methods, processes and means of performing the various works are solely and exclusively the right and responsibility of the Corporation. The Corporation also has the right, and the Union recognizes it, to make and alter, from time to time the rules and regulations to be observed by the employees, which rules and regulations shall not be contrary to the provisions of this Agreement. The Corporation recognizes the foregoing Articles and are subject to such provisions, regulations restrictions governing the exercise of these rights as are provided in this Agreement and are subject to the right of the Union the employee concerned to lodge a grievance in the manner and to the extent herein provided. Rules and regulations the Department shall, time to time, be consolidated and printed in pamphlet form at the expense of the Employer, and a copy thereof shall be distributed to each employee.

The Union recognizes that it is the function of the Region to: Maintain order, discipline and efficiency and, in connection therewith to make, alter, and enforce from time to time regulations and practices to be observed by its employees. Operate and manage its business in all aspects in accordance with its responsibilities and the powers and functions conferred upon the Region by statute and/or by-laws of the Region.
ARTICLE MANAGEMENT FUNCTIONS. The Union recognizes that the Company has the right to manage the business, to exercise all of the prerogatives of management, and without affecting the generality of the foregoing, it has the right to determine the size of and direct the work force, to extend or curtail operations, to hire, promote, except to the extent that the said rights and prerogatives have been specifically delegated to the Union or otherwise curtailed in this Agreement. The Company also has the right to discharge, suspend or otherwise discipline employees for just cause. The above clause shall not deprive the employee of the right to exercise the Grievance Procedure as outlined in this Agreement.

The Union recognizes that the management of the Company and direction of the working forces are fixed exclusively in the Company and without restricting the generality of the foregoing; the Union acknowledges that it is the exclusive function of the Company to: maintain order, discipline and efficiency; hire; retire at normal retirement age; assign; direct; promote; demote; classify; transfer; lay-off; recall; suspend; discharge or otherwise discipline probationary employees for just cause. determine the nature and kind of business conducted by the Company, the products to be carried, the kinds and locations of equipment, merchandise, goods, fixtures and type of customer service to be used, the control of materials and goods, the methods and techniques of work, the schedules of work, number of personnel to be employed; make studies of and institute changes in jobs and job assignments; discontinue, reorganize, limit, combine, substitute any operation or part thereof; and determine all other functions and prerogatives herebefore invested in and exercised by the Company which shall remain solely with the Company; make and enforce and alter from time to time reasonable rules and regulations to be observed by the employees; discipline or discharge a probationary employee for any reason satisfactory to the Company, providing it acts in good faith and in a non-arbitrary manner.
ARTICLE MANAGEMENT FUNCTIONS. The Association recognizes that subject to the provisions of The Police Services Act and the Regulations as amended and made thereunder by the Lieutenant Governor in Council, it is the exclusive function of the Board to: generally supervise and administer the affairs of the Service; maintain order, discipline and efficiency; hire, discharge, direct, classify, transfer, promote, demote or suspend, or otherwise discipline any member: The Board agrees that no member will be dealt with adversely without reasonable cause and that it will exercise the functions outlined in paragraph in a manner consistent with this Agreement, The Police Services Act and the Regulations as amended and made thereunder by the Lieutenant Governor in Council, providing that a claim of discriminatory action relative to any matter contained in this Agreement, may be subjected to the grievance procedure and shall be dealt with as hereinafter provided. If a member claims that the Board has exercised any of the functions outlined in paragraph in violation of this Agreement, then such a claim may be the subject of a grievance under the provisions of the grievance procedure outlined in this Agreement, or the arbitration procedure set out in The Police Services Act, or dealt with under the procedures within the exclusive jurisdiction of the Policing Services Division, as prescribed in The Police Services Act, as the case may be. COLLECTIVE AGREEMENT Jan. to Dec. All members shall be provided with a copy of his Commendation/ Conduct Report when it has been completed by a Senior Officer.
