Amendment to Mortgage. The Mortgage is hereby amended to reflect the resignation of Societe Generale as Administrative Agent and its replacement in such capacity by Bank One, NA as successor Administrative Agent under Credit Agreement, as amended, and pursuant to the terms of the Agency Assignment Agreement dated as of June 29, 2001 as follows:
a. The introductory paragraph to the Mortgage is hereby amended by deleting "SOCIETE GENERALE, whose address is 1221 Avenue of the Americas, ▇▇▇ ▇▇▇▇, ▇▇▇ ▇▇▇▇ ▇▇▇▇▇" and substituting "BANK ONE, NA, whose address is [611 ▇▇▇▇▇▇▇▇ ▇▇▇▇▇▇, ▇▇▇▇▇▇▇, ▇▇ ▇▇▇▇▇]" in place thereof.
b. All references to Mortgagee in the Mortgage are henceforth deemed to be references to Bank One, NA.
Amendment to Mortgage. On or before January 24, 2020 the Borrower shall have delivered to the Administrative Agent an executed amendment to the Mortgage in form and substance satisfactory to the Administrative Agent, which amendment shall increase the amount of indebtedness secured thereby to $11,000,000.
Amendment to Mortgage. Security Agreement, Fixture Filing and Assignment of Rents and Leases dated as of December 19, 2006, by Mortgage Borrower to Mortgage Loan Administrative Agent.
Amendment to Mortgage. At the request of Lender, Borrower shall execute and deliver an amendment to the Mortgage, which amendment shall reflect the modification of the maturity of the term of the Loan and contain such other terms and provisions of the Note as Lender may reasonably request.
Amendment to Mortgage. On or before January 24, 2020 the Borrower shall have caused Icagen-T to deliver to the Administrative Agent an executed amendment to the Mortgage (as defined in the Icagen-T Credit Agreement) in form and substance satisfactory to the Administrative Agent, which amendment shall increase the amount of indebtedness secured thereby to $11,000,000.
Amendment to Mortgage. An Amendment to the Mortgage in form and substance acceptable to the Bank duly executed by the Borrower, a date down endorsement to the title insurance policy in favor of the Bank relating to the Premises and all documents or items required by the title insurance company issuing such date down endorsement in connection therewith.
Amendment to Mortgage. The Mortgage is modified to secure the Note as hereby modified and is deemed amended to conform to the terms and provisions hereof and the amendments and modifications to the Loan and Loan Documents effected hereby. New Borrower hereby assumes and accepts all responsibilities, liabilities and obligations of Original Borrower under the Mortgage.
Amendment to Mortgage. As further security for the Obligations, Borrower will execute and deliver to Bank an amendment to the Mortgage. Said amendment shall be duly recorded where such recording is required to constitute a valid Lien on the Property covered thereby. Such Borrower shall deliver to Bank, at Borrower's expense, an amendment and/or endorsement to the existing mortgagee title insurance policy in form and substance satisfactory to Bank and shall insure a valid first Lien in favor of Bank on the Property covered thereby, subject only to those exceptions acceptable to Bank and its counsel.
Amendment to Mortgage. An amendment to the Mortgage, duly and respectively executed and delivered by National Tobacco Company, L.P., granting to the granting to the Agent Bank, for the benefit of the Banks, reflecting the transactions contemplated herein.
Amendment to Mortgage. The Mortgage shall be amended on the Fifth Restatement Date in accordance with the terms of the Mortgage Amendment.
