Admission Body Clause Samples

The 'Admission Body' clause defines the criteria and process by which an external organization or entity may be admitted to participate in a particular scheme, agreement, or group, often within the context of pension funds or collective arrangements. Typically, this clause outlines the eligibility requirements, application procedures, and any ongoing obligations that the new member must fulfill, such as contribution rates or compliance with specific rules. Its core practical function is to ensure that only qualified entities are allowed to join, thereby maintaining the integrity and stability of the arrangement while providing a clear framework for expanding membership.
Admission Body. Where the Admission Body is exercising the functions of a Scheme employer in connection with more than one contract there needs to be a separate admission agreement for each contract. However, there is no need under the Regulations for the admission agreement to be treated as terminating on expiry of the original contract where that contract is renewed or extended and the terms of the admission agreement are otherwise still appropriate. The optional drafting here requires the written agreement of the Administering Authority in order to provide control over the extension of the admission agreement upon contract renewal / extension, and also to ensure that there is appropriate evidence of the decision to extend beyond the term of the original contract.

Admission Body. Optional drafting, for inclusion either where the Administering Authority wishes as a matter of policy to provide parity of treatment for both exit deficits and surpluses, or where specifically requested by an Admission Body and agreed by the Administering Authority. The provision creates a freestanding contractual obligation to pay a return of surplus to the Admission Body on exit in a case where the statutory obligation to do so does not arise for some reason.
